AN ACT to amend the Radioactive Substances
Act, 1954-1960.
[Assented to 2nd October, 1964.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

(3) The principal Act as amended by this Act may be cited as the Radioactive Substances Act, 1954-1964.

(3) The Commissioner of Public Health or, as the case may be, the medical practitioner appointed a member of the Council on the nomination of the Commissioner pursuant to paragraph (a) of subsection (2) of this section, shall be the chairman of the Council. .

| (a) | by adding after subsection (2), the following subsection |
(2a) Upon receipt of the application referred to in subsection (2) of this section, the Council may register the apparatus subject to such conditions, if any, as the Minister on the recommenda- tion of the Council may impose with respect to the use of the apparatus. ;
| (b) | by adding after subsection (4), the following subsection |
(4a) If the Council is of opinion at any time that the use of an apparatus registered in accordance with the provisions of this section may imperil
| the health of any person, the Council |

shall inform the Minister thereof and thereupon the Minister may cancel the registration of that apparatus for such period as he thinks fit. ;
| (c) | by adding after the word, "section", being the last word in subsection (5), the passage, ", including cancellations of registration made pursuant to subsection (4a) of this section"; and |
| (d) | by adding after subsection (5), the following subsection |
(5a) A medical practitioner or a dentist or a person acting in accordance with his directions who uses for the purpose of taking x-ray photographs an irradiating apparatus that is not registered by the Council in accordance with this section, commits an offence against this Act.
Penalty: Fifty pounds.
