Regulations under the Radioactive Ores and Concentrates (Packaging and Transport) Act 1980

1Citation

These Regulations may be cited as the Radioactive Ores and Concentrates (Packaging and Transport) Regulations 1980.

2Application for licence
  • (1)

    An application under section 12(1) of the Act by an owner of radioactive material or his agent shall be in accordance with Form 1 of the Schedule.

  • (2)

    An application under section 12(2) of the Act by a person who intends to use premises occupied by him for the storage of radioactive material shall be in accordance with Form 2 of the Schedule.

3Form of licences

For the purposes of section 14 of the Act:

  • (a)

    Form 3 of the Schedule shall be the prescribed form for a licence to transport radioactive material; and

  • (b)

    Form 4 of the Schedule shall be the prescribed form for a licence to store radioactive material.

4Prescribed records for transport

For the purposes of section 23 of the Act, a person licensed to transport radioactive material shall keep a record:

  • (a)

    in respect of each load of radioactive material transported, of:

    • (i)

      the dates on which the transportation of the load began and ceased;

    • (ii)

      the nature and quantity of the radioactive material in the load;

    • (iii)

      the place of departure and the destination of the load;

    • (iv)

      the route taken between the place of departure and the destination of the load;

    • (v)

      the name of the person who transported the load and the name of the person in charge of the vehicle transporting the load; and

    • (vi)

      the registration number of the vehicle transporting the load;

  • (b)

    of each licence granted to him under the Act; and

  • (c)

    of the name and date of appointment of each agent and deputy agent appointed by him under the Act.

5Prescribed records for storage

For the purposes of section 23 of the Act, a person licensed to store radioactive material shall:

  • (a)

    in respect of any radioactive material received at the licensed premises, keep a record of:

    • (i)

      the date on which the radioactive material was received;

    • (ii)

      the nature and quantity of the radioactive material;

    • (iii)

      the name of the owner of the radioactive material;

    • (iv)

      the name of the person transporting the radioactive material and the name of the person in charge of the vehicle transporting the radioactive material;

    • (v)

      the registration number of the vehicle transporting the radioactive material; and

    • (vi)

      the condition of the containers in the load and the packaging of the radioactive material;

  • (b)

    in respect of any radioactive material removed from the licensed premises, keep a record of:

    • (i)

      the date on which the radioactive material was removed;

    • (ii)

      the nature and quantity of the radioactive material;

    • (iii)

      the name of the owner of the radioactive material;

    • (iv)

      the period for which the radioactive material was stored on the premises;

    • (v)

      the place to which the radioactive material was transported;

    • (vi)

      the name of the person transporting the radioactive material and the name of the person in charge of the vehicle transporting the radioactive material;

    • (vii)

      the registration number of the vehicle transporting the radioactive material; and

    • (viii)

      the condition of the containers in the load and the packaging of the radioactive material; and

  • (c)

    each licence granted to him under the Act.

6Fee for copy of adopted code, &c.

For section 25(3) of the Act, the prescribed fee for a copy of each code, rule, specification and regulation adopted under section 25(1) of the Act is 23 revenue units.

7Report on operation of licence

Where a licence is subject to a condition that the licensee report on the operation of the licence any report made by the licensee shall be:

  • (a)

    if the licence is a licence to transport radioactive material – in the form of Form 5 of the Schedule; or

  • (b)

    if the licence is to store radioactive material – in the form of Form 6 of the Schedule.

8Signature on application or report

Where a company makes an application, gives notice or provides a report under the Act or these Regulations, that application, notice or report may be signed on behalf of the company by the person in control of the company in the Northern Territory.
