RADIATION SAFETY (GENERAL) AMENDMENT REGULATIONS (No. 2) 1997

Made by the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Radiation Safety (General)

Principal regulations

2. In these regulations the Radiation Safety (General) Regulations 1983* are referred to as the principal regulations.

Regulation 3 amended

3.      Regulation 3 of the principal regulations is amended -

by deleting the definitions of "radiation emission limit" and

(a) "recognized test procedure"; and
(b) by inserting in the appropriate alphabetical position the following

definition -

In

"microwave oven standard" means the publication entitled "Approval and Test Specification - Particular Requirements for Microwave Ovens", being AS 3301 - 1992, published by the Standards Association of Australia;

Regulation 7 amended

"regulations 39 (1), 42, 43, 44, 45, 46, 47, 49 and 50" and substituting the following - 4. Regulation 7 (2) of the principal regulations is amended by deleting

49    regulations 39 and 40 ".

Regulations 39 to 51 repealed and regulations substituted

5.      Regulations 39 to 51 of the principal regulations are repealed and the

following regulations are substituted -

New microwave ovens to comply with microwave oven standard

39.     A person shall not sell a microwave oven as a new microwave

oven unless it complies with the requirements of the microwave oven

standard.

Commercial microwave ovens to be tested

40. (1) The owner of a microwave oven which is used for purposes other than domestic or scientific purposes shall not operate or use it, or permit it to be operated or used, unless the oven has within the previous 3 years passed a compliance test.

(2) In subregulation (1) -

"compliance test" means a test, conducted in accordance with the test procedure, set out in item 32.1 of the microwave oven standard, to ensure that the oven complies with the radiation emission limit set out in that item.

Schedule I amended

6.     Item 2 (2) of Schedule I to the principal regulations is amended by

deleting "limit." and substituting the following -
" limit set out in item 32.1 of the microwave oven standard.

Schedule III repealed

7.      Schedule III to the principal regulations is repealed.

Schedule VII amended

8.      Schedule VII to the principal regulations is amended —

by deleting "[Regulations 7, 43 and 50]" and substituting the

(a) following —

" [Regulation 7] "; and

(b) by deleting item 1 and substituting the following item —
" 1. Microwave ovens. ".
