Radiation Safety (General) Amendment

Regulations 2010

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Radiation Safety (General)
Amendment Regulations 2010.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Radiation Safety (General)
Regulations 1983.

4.             Regulation 3 amended

(1) In regulation 3(1) delete the definitions of:

class 1 laser class 2 laser class 3A laser

class 3B laser
class 3B(R) laser
class 4 laser
laser safety standard
(2) In regulation 3(1) insert in alphabetical order:

class 1 laser means a class 1 laser product as defined

by section 3.17 of the laser safety standard;

class 2 laser means a class 2 laser product as defined
by section 3.19 of the laser safety standard;

class 3B laser means a class 3B laser product as

defined by section 3.21 of the laser safety standard;

class 3R laser means a class 3R laser product as

defined by section 3.21 of the laser safety standard;

class 4 laser means a class 4 laser product as defined

by section 3.22 of the laser safety standard;

laser safety standard means the publication entitled
“Safety of laser products”, being AS/NZS 2211.1:2004,
published by Standards Australia in March 2004;

5.             Regulation 27 amended

(1) Delete regulation 27(4) and insert:
(4) A licensee must not use sealed sources in radiation
gauges unless in so doing the licensee complies with
the requirements of the publication entitled “Code of
Practice and Safety Guide for the Safe Use of Fixed
Radiation Gauges (2007)” published by the Australian
Radiation Protection and Nuclear Safety Agency
in 2007.
(2) In regulation 27(5)(b) delete ““Code of Practice on Radiation
Protection in the Mining and Milling of Radioactive Ores 1987”
published for the Department of the Arts, Sport, the
Environment, Tourism and Territories of the Commonwealth in
1987. ” and insert:

“Code of Practice and Safety Guide for
Radiation Protection and Radioactive Waste
Management in Mining Mineral Processing
(2005)” published by the Australian Radiation
Protection and Nuclear Safety Agency in 2005.

6.             Regulation 28 amended

In regulation 28(1):

(a)

in paragraph (d) delete ““Code of Practice on Radiation Protection in the Mining and Milling of Radioactive Ores 1987” published for the Department of the Arts, Sport, the Environment, Tourism and Territories of the Commonwealth in 1987;” and insert:

“Code of Practice and Safety Guide for
Radiation Protection and Radioactive Waste
Management in Mining Mineral Processing
(2005)” published by the Australian Radiation

Protection and Nuclear Safety Agency in 2005; and

(b)

in paragraph (g)(i) delete ““The Code of Practice for the Safe Use of Radiation Gauges” approved by the NHMRC at its 93rd Session in June 1982 (in this paragraph called the Code); and” and insert:

“Code of Practice and Safety Guide for
the Safe Use of Fixed Radiation Gauges
(2007)” published by the Australian
Radiation Protection and Nuclear Safety

Agency in 2007 (the Code); and

(c) after each of paragraphs (a), (b), (c) and (e) insert:

and

7.             Regulation 56 amended

In regulation 56(1):

(a) in paragraph (a) delete “Tables VI, VII and VIII of the laser safety standard;” and insert:

Tables 6 and 8 of the laser safety standard; and

(b) in paragraph (d) delete “Tables VI, VII and VIII of the laser safety standard.” and insert:

Tables 6 and 8 of the laser safety standard.

(c) after paragraph (b) insert:

and

8.             Regulation 60 deleted

In Part VI delete regulation 60.

9.             Schedule I amended

In Schedule I clause 2(1):

(a)

delete paragraphs (aa) and (b) and “or” after paragraph (b) and insert:

radiofrequency fields with frequencies from 3 kHz to 300 GHz which exceed the limits specified in the publication entitled “Maximum Exposure Levels to
