Radiation Safety Amendment Regulation (No. 1) 2013 [s 1] 1 Short title This regulation may be cited as the Radiation Safety Amendment Regulation (No. 1) 2013 . 2 Regulation amended This regulation amends the Radiation Safety Regulation 2010. 3 Amendment of s 65 (Prescribed matters for banning of certain radiation practices—Act, s 47A) Section 65(2), from ‘the following’— omit, insert — the use in a private residence of a solarium owned by an individual and not used for a business. 4 Insertion of new s 80A Part 12, division 2— insert — 80A Relevant solarium—Act, s 210 (1) For the Act, section 210, a relevant solarium is exempt from the Act, sections 12, 23, 24 and 27 if the relevant solarium is being supplied by a possession licensee to the chief executive. Radiation Safety Amendment Regulation (No. 1) 2013 [s 8] commencement means the commencement of this section. 98 Application of s 64A (1) This section applies if a possession licensee, under the licence— (a) possesses a relevant solarium immediately before the commencement; and (b) continues to possess the relevant solarium on the commencement. (2) Section 64A does not apply to the relevant solarium until the earlier of the following— (a) the licence ends; (b) 31 December 2014. 99 Particular solarium continues to be relevant solarium (1) This section applies to a solarium if, immediately before the commencement, the solarium is a relevant solarium. (2) Despite schedule 9, definition relevant solarium , the solarium continues to be a relevant solarium after the commencement. 8 Amendment of sch 9 (Dictionary) (1) Schedule 9, definition privately owned — omit . (2) Schedule 9, definition relevant solarium , from ‘the following’— omit, insert — a solarium owned by an individual and not used for a business. Page 4 2013 SL No. 288
