Radiation Safety Amendment Regulation (No. 1) 2009 [s 1] 1 Short title This regulation may be cited as the Radiation Safety Amendment Regulation (No. 1) 2009 . 2 Regulation amended This regulation amends the Radiation Safety Regulation 1999. 3 Amendment of s 9 (Certain possession, use or transport licences—Act, s 75(3) and (4)) (1) Section 9(1)(a)— omit . (2) Section 9(1)(f), ‘for medical applications’— omit, insert— ‘to carry out a diagnostic or therapeutic procedure’. (3) Section 9(1)(b) to (g)— renumber as section 9(1)(a) to (f). (4) Section 9(1), editor’s note— omit, insert— ‘Editor’s note Copies of the documents referred to in paragraphs (a) to (f) are available on the internet at < Copies of the documents referred to in paragraphs (a) to (f) may also be purchased from ARPANSA, 619 Lower Plenty Road, Yallambie, Victoria 3085.’. 4 Amendment of s 35A (Mineral substances that are not radioactive substances) Section 35A(1), ‘but that’— omit, insert— ‘that’. Radiation Safety Amendment Regulation (No. 1) 2009 [s 5] 5 Amendment of s 39C (Prescribed matters for banning of certain radiation practices—Act, s 47A) Section 39C(2)(a)— omit, insert— ‘(a) use of a solarium by a health practitioner to carry out a diagnostic or therapeutic procedure;’. 6 Amendment of sch 3A (Authorised persons) Schedule 3A, part 2, item 18— omit, insert— ‘18 treatment of benign a person who is— conditions involving (a) registered as a specialist registrant in the use of unsealed the specialty of nuclear medicine radioactive substances under the Medical PractitionersRegistration Act 2001 ; or (b) a medical practitioner and undergoing a period of training in the specialty of nuclear medicine’.
