RADIATION CONTROL ACT 1990 - REGULATION

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Radiation Control Act 1990, has been pleased to make the Regulation set forth hereunder.

Citation
1. This Regulation may be cited as the Radiation Control
(Transitional) Regulation 1990.
Commencement
2. This Regulation commences on 14 December 1990.
Exercise of Council’s functions
3. (1) The functions of the Radiological Advisory Council under the Radioactive Substances Act 1957, or any other Act, may be exercised by the Radiation Advisory Council.
(2) For the purpose of this clause, a reference in any such Act (or an instrument made under any such Act) to the Radiological Advisory Council is to be read as a reference to the Radiation Advisory Council.
(3) For the purposes only of this clause, sections 4 and 5 of the
Radioactive Substances Act 1957 have no operation.

(4) This clause ceases to have effect on the commencement of
section 43 (1) of the Radiation Control Act 1990.

EXPLANATORY NOTE
The object of this Regulation is to make a transitional arrangement consequent on the proposed commencement of the provisions of the Radiation Control Act 1990 relating to the establishment of the Radiation Advisory Council. Pending the full commencement of the Radiation Control Act 1990, the Regulation enables the Radiation Advisory Council to exercise the functions of the Radiological Advisory Council under the provisions of the Radioactive Substances Act 1957.
