Radiation Control Act 1990

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Radiation Control Act 1990.

Explanatory note
The objects of this Regulation are:

(a) to prescribe cyclotrons as radiation apparatus that require registration under the Radiation Control Act 1990, and
(b) to prescribe fees for the grant and renewal of registration of cyclotrons, and
(c) to increase other fees payable under the Act, and
(d) to update a reference to a document, as a result of which the amended regulation will require radioactive substances to be transported in accordance with the requirements of the Code of Practice for the Safe Transport of Radioactive Material published in September 2001 by the Chief Executive Officer of the Australian Radiation Protection and Nuclear Safety Agency.

This Regulation is made under the Radiation Control Act 1990, including sections 7, 11 and 40 (the general regulation-making power).

Radiation Control Amendment Regulation 2001

  1. Name of Regulation

    This Regulation is the Radiation Control Amendment Regulation 2001.

2 Commencement

This Regulation commences on 1 December 2001.

  1. Amendment of Radiation Control Regulation 1993

    The Radiation Control Regulation 1993 is amended as set out in
    Schedule 1.

(Clause 3)

  1. Clause 10A

    Omit the clause. Insert instead:

10A Registration of certain radiation apparatus

For the purposes of section 7 (1) (b) of the Act, the following kinds of radiation apparatus are prescribed as apparatus to which section 7 applies:

(a) any ionising radiation apparatus used or intended to be used for any medical diagnostic, veterinary diagnostic or dental diagnostic purpose,
(b) any cyclotron.
  1. Clause 11 Consulting radiation experts

    Insert “or (f)–(g)” after “(a)–(d)” wherever occurring in clause 11 (2).

  2. Clause 11 (2)

    Insert “or (h)” after “1 (e)” wherever occurring.

  3. Clause 12 Fees

    Omit the Table. Insert instead:
