CaseChat Overview and Summary

The Fair Work Commission was asked to approve a proposed single enterprise agreement for the racing industry, specifically the Racing Victoria Raceday Officials Agreement 2024-2027. The agreement was to cover the period from 1 July 2024 to 30 June 2027. The Australian Workers' Union, acting as a bargaining representative for the agreement, had given notice under section 183 of the Fair Work Act 2009 that it wanted the agreement to cover it. The legal issue before the Commission was whether the proposed agreement met the requirements of the Fair Work Act 2009 and whether it was fair and reasonable for the purposes of section 235 of the Act.

The Commission noted that the Australian Workers' Union had given notice under section 183 of the Act that it wanted the agreement to cover it. In accordance with section 201(2) of the Act, the agreement did cover this organisation. The Commission considered the agreement in light of the requirements of the Fair Work Act 2009 and the principles of good faith bargaining. The Commission was satisfied that the agreement met the requirements of the Act and was fair and reasonable for the purposes of section 235 of the Act.

The Commission approved the Racing Victoria Raceday Officials Agreement 2024-2027, subject to the corrected paragraph [5]. The agreement was approved from 1 July 2024 to 30 June 2027. The Commission made an order approving the agreement as a single-enterprise agreement under section 185 of the Fair Work Act 2009. The Commission also noted that the agreement would be registered with the Fair Work Commission Registry.
