[ASSENTED TO 18TH DECEMBER, 1946.] Short title. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (2.) This Act shall, on and after the commencement hereof, continue in force until the date upon which the Governor in Council shall, by Proclamation published in the Gazette, terminate its operation. Meaning of 3. In this Act, unless the context otherwise indicates $erms. or requires, the following terms shall have the meanings respectively assigned to them, that is to say : - Rmaeceeting for horses. Rmaeceeting for dogs. Racing Itimitation Act. 81 " Metropolitan Area "-Means an area comprising Metropolitan the area of the City of Brisbane as defined Area. by *" The Oity of Brisbane Acts, 1924 to 1945," the area of the City of Ipswich as constituted under t" The Local Government Acts, 1936 to 1946," the area between the said cities bounded on each side of the railway line between the said cities by a line running parallel with and distant five miles from such railway line, and also such area as will include the racecourse at or near Strathpine in the State of Queensland. A reference in this Act to any other Act shall be deemed to refer also to any Act passed hereafter in amendment of or substitution for such Act. 4. On and from the commencement of this Act, no Days on race meeting for horses or race meeting for dogs shall be i: h: : ~ ~ ft~ ~ ' : t~ conducted:- (a) In the Metropolitan Area except on the following days, that is to say:- (i.) On a Saturday; (ii.) On any day, not being a Saturday, on which occurs a holiday constituted by or in pursuance of t" The Holidays Acts, 1912 to 1935" (or on a day appointed under the lastmentioned Acts to be kept in place of any such holiday), and not being Good Friday, Christmas Day, or Anzac Day. (b) In the Cities of Bundaberg, Cairns, Charters Towers, Gympie, Mackay,' Maryborough, Rockhampton, Toowoomba, Townsville, and Warwick, as constituted under t" The Local Government Acts, 1936 to 1946," except on the following days, that is to say:- (i.) On a Saturday; (ii.) No. 3, 1946. pursuance of *" The Holidays Acts, 1912 to 1935" (or on any day appointed under the lastmentioned Acts to be kept in place of any such holiday), and not being Good Friday, Christmas Day, or Anzac Day; (iii.) On any day not being a Saturday or a holiday mentioned in subparagraph (ii.) of this paragraph (b) on which are held annual and well-established meetings of particular interest to the City in which such meeting is conducted: Provided that no meeting other than those referred to in subparagraphs (i.) and (ii.) of this paragraph (b) shall be held on a day to which this subparagraph relates unless approval to conduct such meeting on such day has been granted by the Minister as defined in t" The Racing and Cour8ing Regulation Acts, 1930 to 1936," on the application of the Racing Club made at least twenty-one days before such day. Allotment of racing days. 5. The Governor in Council may, from time to time, by Order in Council published in the Gazette allot among the racing clubs specified in such Order in Council the days for race meetings for horses in the Metropolitan Area for the period specified in such Order in Council. Any such Order in Council may be made and published in the Gazette at any time after the passing of this Act. Penalties. 6. If any race meeting for horses or race meeting for dogs is conducted in the Metropolitan Area or in any City upon any day upon which this Act prohibits the conducting of such meeting, such meeting shall be deemed to have been conducted in contravention of t" The Racing and Coursing Regulation Acts, 1923 to 1936," and that Act, and in particular the provisions of sections twenty-seven and thirty-one thereof, shall apply and extend accordingly.
