Racing and Gaming Amendment Act 2000

An Act to amend the Racing and Gaming Act 1952 and the Racing and Gaming Regulations 1976

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Racing and Gaming Amendment Act 2000 . 2Commencement (1)  Sections 4 and 7 are taken to have commenced on 22 December 1999. (2)  Section 5 commences on 1 July 2000. (3)  The remaining provisions of this Act commence on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Racing and Gaming Act 1952 is referred to as the Principal Act. 4Section 70 amended (Payment of commission by bookmakers) Section 70(1) of the Principal Act is amended as follows: (a) by omitting from paragraph (a) "1·5%" and substituting "1%"; (b) by omitting from paragraph (b) "2·0%" and substituting "1%". 5Section 70 amended (Payment of commission by bookmakers) Section 70 of the Principal Act is amended as follows: (a) by inserting in subsection (1) "in respect of each month" after "Director"; (b) by inserting in subsection (1)(a) "during that month" after "him"; (c) by inserting in subsection (1)(b) "during that month" after "him"; (d) by inserting in subsection (1)(c) "during that month" after "bookmaker"; (e) by inserting in subsection (1)(d) "during that month" after "bookmaker"; (f) by omitting subsection (2) and substituting the following subsection: (2)  A bookmaker must pay the commission payable under subsection (1) in relation to a month not later than 7 days after the end of that month. (g) by inserting the following subsections after subsection (4) : (5) The commission that would have been payable by a bookmaker on 4 July 2000 in respect of the week ending on 1 July 2000 had section 5 of the Racing and Gaming Amendment Act 2000 not commenced remains payable on that day as if that section had not so commenced. (6)  The commission payable by a bookmaker under this section in respect of the month of July in the year 2000 is to be calculated exclusive of the first day of that month. 6Section 70 amended (Payment of commission by bookmakers) Section 70(1) of the Principal Act is amended as follows: (a) by omitting from paragraph (c) "New Zealand, other than bets made under a telephone sports betting licence" and substituting "New Zealand"; (b) by omitting from paragraph (d) "New Zealand, other than bets made under a telephone sports betting licence" and substituting "New Zealand". 7Racing and Gaming Regulations 1976 amended Regulation 122H of the Racing and Gaming Regulations 1976 is amended as follows: (a) by omitting "2%" from subregulation (1) and substituting "1%"; (b) by omitting "2%" from subregulation (2) and substituting "1%".
