Racing and Gaming Amendment Act 1999

An Act to amend the Racing and Gaming Act 1952

[Royal Assent 22 December 1999]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Racing and Gaming Amendment Act 1999 . 2CommencementThis Act commences, or is taken to have commenced, on the day on which the Gaming Control Amendment Act 1999 commences. 3Principal ActIn this Act, the Racing and Gaming Act 1952 is referred to as the Principal Act. 4Section 3 amended (Interpretation) Section 3 of the Principal Act is amended as follows: (a) by omitting the definition of approved representative ; (b) by omitting the definitions of pool , pool betting and pool betting licence ; (c) by omitting the definition of telephone sports betting licence . 5Part V, Division III repealed Division III of Part V of the Principal Act is repealed. 6Section 84 amended (Lotteries unlawful except as prescribed) Section 84 of the Principal Act is amended by inserting "or the Gaming Control Act 1993 " after "Part". 7Part VI, Divisions II and IIA repealed Divisions II and IIA of Part VI of the Principal Act are repealed. 8Section 104 substituted Section 104 of the Principal Act is repealed and the following section is substituted: 104Tasmanian gaming licence lottery not affected This Division does not apply in relation to a lottery conducted under the authority of a Tasmanian gaming licence, endorsed with a major lottery endorsement, in force under the Gaming Control Act 1993 . 9Section 114 amended (Avoidance of agreements relating to gaming) Section 114(3) of the Principal Act is amended as follows: (a) by omitting from paragraph (d)(iii)(B) "them." and substituting "them; or"; (b) by inserting the following paragraph after paragraph (d) : (e) any gaming or wagering authorised under any other Act. 10Section 119 amended (Regulations) Section 119(2) of the Principal Act is amended as follows: (a) by omitting from paragraph (db) "activity;" and substituting "activity."; (b) by omitting paragraph (e) .
