2 Racing and Betting Amendment (No. 1) No. 48, 1993 ˙ Short title 1. This regulation may be cited as the Racing and Betting Amendment Regulation (No. 1) 1993 . ˙ Amended regulation 2. The Racing and Betting Regulation 1981 is amended as set out in this regulation. ˙ Replacement of ss.52 and 52A 3. Sections 52 and 52A— omit, insert— ˙ ‘Definitions ‘52. In sections 52A to 52AC— “approved racing program” of a racing club means a racing program approved by the Greyhound Board, the Harness Racing Board or the Queensland Principal Club; “racing club” means a club specified in Schedule 8. ˙ ‘Application of sections 52AA–52AC ‘52A.(1) Sections 52AA to 52AC apply to the payment to a racing club out of the net profits of the Totalisator Board. ‘(2) A payment made by the Totalisator Board to a racing club in relation to a period ending on 30 June 1993 is to be made under section 52 as in force immediately before the commencement of this subsection. ˙ ‘Determination of payment ‘52AA.(1) Subject to section 52AB, the amount to be paid to a racing club for the financial year starting on 1 July 1993 is to be the amount paid to the club for the financial year ending on 30 June 1992 increased or reduced by an amount (not more than 25%) fixed by the Totalisator Board by Gazette notice.

3 Racing and Betting Amendment (No. 1) No. 48, 1993 ‘(2) The amount paid to a racing club for a financial year starting on or after 1 July 1994 is to be the amount paid to the club for the previous financial year increased or reduced by an amount (not more than 25%) fixed by the Totalisator Board by Gazette notice. ˙ ‘Eligibility for payment ‘52AB. The Totalisator Board may pay an amount to a racing club only if— (a) the racing club has run the whole or a part of its approved racing program for the financial year in relation to which the payment is to be made; and (b) the amount to be paid is not more than the amount paid by the racing club as prize money in that financial year. ˙ ‘Incentive payments ‘52AC. The Totalisator Board may apply a part of its net profits and other money to the payment of an incentive to clubs under a scheme approved by the Minister. ’. ˙ Insertion of new Part 7AA 4. After Part 7— insert— ‘PART 7AA—PAYMENTS OUT OF RACING DEVELOPMENT FUND ˙ ‘Payments from the Fund ‘84AA.(1) The Minister may recommend the payment from the Racing Development Fund to clubs (other than racing clubs mentioned in Schedule 8) of an advance to be used for the development of racing. ‘(2) In the financial year starting on 1 July 1993, the amount available for payment is not less than $5 million. ’.
