This regulation may be cited as the Racing and Betting Amendment Regulation 1992 . Commencement 2. This regulation commences on 1 March 1992.

3 Racing and Betting Amendment Regulation 1992 Amended regulation 3. The Racing and Betting Regulation 1981 is amended as set out in this regulation. Replacement of ss.1 to 4 4. Sections 1 to 4— omit , insert — ‘Short title ‘1. This regulation may be cited as the Racing and Betting Regulation 1981 . ‘Definition ‘2. In this regulation— ‘ “prescribed form” means— (a) a form in Schedule 1; and (b) a form approved by the chief executive under section 3. ‘Approval of forms ‘3. The chief executive may approve a form— (a) for a purpose under the Act or this regulation for which a prescribed form is required or authorised to be used; or (b) for use for any purpose in connection with the administration of the Act or this regulation. ‘Fees ‘3A. The fee set out in Schedule 2 is the fee payable for the matter to which it relates.

4 Racing and Betting Amendment Regulation 1992 ‘Composition of the South-East Queensland Racing Association ‘4. The South-East Queensland Racing Association is comprised of the following members— (a) 2 nominated by the Queensland Turf Club; (b) 2 nominated by the Brisbane Amateur Turf Club; (c) 1 nominated by the Gold Coast Turf Club; (d) 1 nominated by the Sunshine Coast Turf Club; (e) 1 nominated by the Ipswich Turf Club; (f) 1 nominated by the Tattersall’s Racing Club, Brisbane; (g) 1 nominated jointly by the clubs mentioned in Schedule 3; (h) 1 nominated by licensed trainers; (i) 1 nominated by licensed bookmakers; (j) 1 nominated by licensed jockeys. ‘Composition of the Downs and South-West Queensland Racing Association ‘4A. The Downs and South-West Queensland Racing Association is comprised of the following members— (a) 1 nominated by the Central Warrego Race Club; (b) 1 nominated by the Dalby and Northern Downs Jockey Club; (c) 1 nominated by the Roma Turf Club; (d) 3 nominated by the Toowoomba Turf Club; (e) 1 nominated by the Warwick Turf Club Inc.; (f) 2 nominated jointly by the clubs mentioned in Schedule 4; (g) 1 nominated by licensed trainers; (h) 1 nominated by licensed bookmakers; (i) 1 nominated by licensed jockeys.

5 Racing and Betting Amendment Regulation 1992 ‘Composition of the North Queensland Racing Association ‘4B. The North Queensland Racing Association is comprised of the following members— (a) 1 nominated by the Cairns Jockey Club Inc.; (b) 1 nominated by the Mackay Turf Club Inc.; (c) 1 nominated by the Mt Isa Race Club; (d) 2 nominated by the Townsville Turf Club; (e) 3 nominated jointly by the clubs mentioned in Schedule 5; (f) 1 nominated by licensed trainers; (g) 1 nominated by licensed bookmakers; (h) 1 nominated by licensed jockeys. ‘Composition of the Capricornia Racing Association ‘4C. The Capricornia Racing Association is comprised of the following members— (a) 1 nominated by the Emerald Jockey Club Inc.; (b) 1 nominated by the Gladstone Jockey Club; (c) 3 nominated by the Rockhampton Jockey Club; (d) 1 nominated by the Thangool Race Club; (e) 1 nominated by the Yeppoon Turf Club Inc.; (f) 1 nominated jointly by the clubs mentioned in Schedule 6; (g) 1 nominated by licensed trainers; (h) 1 nominated by licensed bookmakers; (i) 1 nominated by licensed jockeys. ‘Composition of the Central-Western Queensland Racing Association ‘4D. The Central-Western Queensland Racing Association is comprised of the following members— (a) 1 nominated by the Barcaldine Racing Club;

6 Racing and Betting Amendment Regulation 1992 (b) 1 nominated by the Barcoo Amateur Racing Club; (c) 1 nominated by the Clermont Race Club; (d) 1 nominated by the Longreach Jockey Club; (e) 1 nominated by the Moranbah Race Club; (f) 1 nominated jointly by the clubs mentioned in Schedule 7; (g) 1 nominated by licensed trainers; (h) 1 nominated by licensed bookmakers; (i) 1 nominated by licensed jockeys. ‘Nomination of member to racing association ‘4E.(1) The nomination of a member to a racing association must be made as soon as practicable after 28 February in each year that nominations are to be made. ‘(2) A member of a racing association is eligible for renomination and reappointment as a member. ‘Appointment of member to racing association ‘4F. A person nominated under sections 4 to 4D is, on nomination, appointed a member of the racing association for which the person is nominated. ‘Tenure of office ‘4G. A member of a racing association holds office— (a) in the case of the first nominations after the commencement of this section—until 28 February 1995; and (b) in the case of subsequent nominations—for a period of 3 years from the day the member is appointed.

7 Racing and Betting Amendment Regulation 1992 ‘Vacation of office ‘4H. The office of a member becomes vacant if the member— (a) dies; or (b) becomes incapable of continuing as a member; or (c) resigns, by signed notice given to the racing association. ‘Casual vacancies ‘4I.(1) If a casual vacancy happens in the office of a member, another person is to be nominated and appointed in the same way as the person whose office has become vacant was nominated and appointed. ‘(2) A person appointed to fill a casual vacancy as a member is to be appointed and to hold office for the balance of the term of the office of the person’s predecessor or until the person sooner vacates office. ‘Racing association may regulate its own proceedings ‘4J. A racing association may regulate its proceedings as it considers appropriate. ’. Amendment of s.4A (Club declaration of bookmakers’ total bets) 5. Section 4A— omit ‘ is to be in accordance with Form 16 in the First Schedule ’, insert ‘ must be in the prescribed form ’. Renumbering of s.4A (Club declaration of bookmakers’ total bets) 6. Section 4A— renumber and reposition as 5A (in Part 2). Omission of ss.5A and 5B 7. Sections 5A and 5B— omit .

8 Racing and Betting Amendment Regulation 1992 Amendment of s.17 (Supply and control of betting sheets) 8.(1) Section 17(1)— omit , insert — ‘(1) A requisition for the supply of books of betting sheets must be made in the prescribed form. ’. (2) Section 17(4)— omit ‘ in form 14 ’, insert ‘ in the prescribed form ’. Amendment of s.17A (Bookmaker’s return of all bets made) 9. Section 17A— omit ‘ is to be in accordance with Form 15 in the First Schedule ’, insert ‘ must be in the prescribed form ’. Amendment of s.51B (Application for and approval of sports betting) 10. Section 51B— omit ‘ shall be in Form 25 ’, insert ‘ must be in the prescribed form ’. Replacement of ss.52A and 52B 11. Sections 52A and 52B— omit , insert — ‘Distribution to control bodies and other bodies ‘52A. Each financial year the Totalisator Board must pay, out of net profits, each body mentioned in the following table the amount opposite the name of the body for the purpose mentioned.

A declaration of totalisator transactions under section 200 of the Actmust be in the prescribed form and forwarded to the Commissioner— (a) in the case of transactions in relation to the Totalisator Board—not more than 7 days after the end of each operating week; and (b) in the case of transactions in relation to an operator of a totalisator other than the Totalisator Board—not more than 7 days after the day of the meeting on which the totalisator operated. ’. Amendment of Schedule 1 13.(1) Schedule 1— omit Forms 1 to 10, 13 to 20 and 25. (2) Schedule 1 (Form 21)— omit ‘ Section 231 ’, insert ‘ section 231 of the Act ’. (3) Schedule 1 (Form 22)— omit ‘ Section 231 ’, insert ‘ section 231 of the Act ’. (4) Schedule 1 (Form 23)— omit ‘ Section 218A ’, insert ‘ section 218A of the Act ’. (5) Schedule 1 (Form 24)— omit ‘ Section 218A ’, insert ‘ section 218A of the Act ’. Replacement of Schedule 2 (Fees) 14. Schedule 2— omit , insert —
