s1 3 s4 Racing Amendment Regulation (No. 1) 2005 No. 172, 2005 1 Short title This regulation may be cited as the Racing Amendment Regulation (No. 1) 2005 . 2 Commencement This regulation commences on 1 August 2005. 3 Regulation amended This regulation amends the Racing Regulation 2003 . 4 Replacement of pt 3 (Racing associations) Part 3— omit, insert— ‘Part 3 Country racing associations ‘Division 1 Composition of country racing associations ‘7 Capricornia Country Racing Association ‘(1) The Capricornia Country Racing Association is comprised of the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member— (a) licensed trainers; (b) racing bookmakers; (c) licensed jockeys; (d) each club mentioned in schedule 1, part 1. ‘8 Central West Country Racing Association ‘(1) The Central West Country Racing Association is comprised of the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member—

s4 4 s4 Racing Amendment Regulation (No. 1) 2005 No. 172, 2005 (a) licensed trainers; (b) racing bookmakers; (c) licensed jockeys; (d) each club mentioned in schedule 1, part 2. ‘9 Downs Country Racing Association ‘(1) The Downs Country Racing Association is comprised of the the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member— (a) licensed trainers; (b) racing bookmakers; (c) licensed jockeys; (d) each club mentioned in schedule 1, part 3. ‘10 Eastern Downs Country Racing Association ‘(1) The Eastern Downs Country Racing Association is comprised of the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member— (a) licensed trainers; (b) racing bookmakers; (c) licensed jockeys; (d) each club mentioned in schedule 1, part 4. ‘11 Far North Country Racing Association ‘(1) The Far North Country Racing Association is comprised of the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member— (a) licensed trainers; (b) racing bookmakers;

s4 5 s4 Racing Amendment Regulation (No. 1) 2005 No. 172, 2005 (c) licensed jockeys; (d) each club mentioned in schedule 1, part 5. ‘12 Leichardt Country Racing Association ‘(1) The Leichardt Country Racing Association is comprised of the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member— (a) licensed trainers; (b) racing bookmakers; (c) licensed jockeys; (d) each club mentioned in schedule 1, part 6. ‘13 North West Country Racing Association ‘(1) The North West Country Racing Association is comprised of the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member— (a) licensed trainers; (b) racing bookmakers; (c) licensed jockeys; (d) each club mentioned in schedule 1, part 7. ‘14 South East Country Racing Association ‘(1) The South East Country Racing Association is comprised of the members nominated under subsection (2). ‘(2) Each of the following may nominate 1 member— (a) licensed trainers; (b) racing bookmakers; (c) licensed jockeys; (d) each club mentioned in schedule 1, part 8.

s4 6 s4 Racing Amendment Regulation (No. 1) 2005 No. 172, 2005 ‘Division 2 Nomination and appointment of members of country racing associations ‘15 Nomination of certain members ‘(1) As soon as practicable after 27 February in each year in which nominations for members of a country racing association are to be made, the thoroughbred control body must invite licensed trainers, racing bookmakers and licensed jockeys to nominate a person for membership of the association. ‘(2) If 1 person is nominated for membership of the country racing association by the licensed trainers, racing bookmakers or licensed jockeys, the person is nominated as the member for division 1. ‘(3) If more than 1 person (each a nominee ) is nominated for membership of the country racing association by the licensed trainers, racing bookmakers or licensed jockeys, the thoroughbred control body must conduct an election to decide the nominee who is nominated as the member for division 1. ‘16 Period for nomination of members ‘The nomination of a person as a member of a country racing association must be made after 27 February and before 1 July in each year in which nominations are to be made. ‘16A Appointment of member of country racing association ‘(1) A person nominated as a member of a country racing association for division 1 is appointed a member of the association on 1 August in the year the nomination is made. ‘(2) A member of a country racing association is eligible for renomination and reappointment as a member.

s4 7 s4 Racing Amendment Regulation (No. 1) 2005 No. 172, 2005 ‘16B Term of office ‘A member of a country racing association holds office for 2 years starting on the day the member is appointed. ‘16C Revocation of nomination by club ‘A club mentioned in schedule 1 may revoke its nomination of a person as a member of a country racing association only if at least three-quarters of the club’s members or, if three-quarters is not a whole number, the next highest whole number of its members, agree to revoke the nomination. ‘16D Vacation of office ‘The office of a member of a country racing association becomes vacant if— (a) the member dies; or (b) the member becomes incapable of continuing as a member; or (c) the member resigns by signed notice given to the association; or (d) the member is absent from 3 consecutive meetings of the association and is not excused by the chairperson of the association for the absences at any time before the end of the next meeting after the third absence; or (e) for a member of the association nominated by a club mentioned in schedule 1— (i) the club gives the chairperson of the association notice that the member’s nomination has been revoked under section 16C; or (ii) the club ceases to be a club mentioned in schedule 1 for the association. ‘16E Casual vacancies ‘(1) This section applies if the office of a member (the previous member ) of a country racing association becomes vacant, otherwise than under section 16D(e)(ii).

s5 8 s5 Racing Amendment Regulation (No. 1) 2005 No. 172, 2005 ‘(2) If a club mentioned in schedule 1 nominated the previous member, the club may nominate another person (the replacement member ) for membership of the country racing association. ‘(3) If the previous member was nominated by licensed trainers, racing bookmakers or licensed jockeys the thoroughbred control body must, as soon as practicable after the vacancy happens, invite licensed trainers, racing bookmakers or licensed jockeys to nominate another person for membership of the country racing association. ‘(4) If 1 person is nominated for membership of the country racing association by the licensed trainers, racing bookmakers or licensed jockeys, the person is nominated as the member (also the replacement member ) for division 1. ‘(5) If more than 1 person (each a nominee ) is nominated for membership of the country racing association by the licensed trainers, racing bookmakers or licensed jockeys, the thoroughbred control body must conduct an election to decide the nominee who is nominated as the member (also the replacement member ) for division 1. ‘(6) A replacement member— (a) is, on nomination, appointed as a member of the country racing association; and (b) holds office for the balance of the previous member’s term of office.’. 5 Amendment of s 23 (Prescribed laws about racing or betting) Section 23, ‘schedule 6’— omit, insert— ‘schedule 2’.

s6 9 s7 Racing Amendment Regulation (No. 1) 2005 No. 172, 2005 6 Amendment of s 24 (Fees) Section 24, ‘schedule 7’— omit, insert— ‘schedule 3’. 7 Insertion of new pt 6 After section 24— insert— ‘Part 6 Transitional provision for Racing Amendment Regulation (No. 1) 2005 ‘25 First appointment of members of country racing associations ‘(1) This section applies despite sections 15 to 16B. ‘(2) As soon as practicable after the commencement— (a) each club mentioned in schedule 1 may nominate a person as a member of the country racing association for which the club may nominate a member for part 3, division 1; and (b) the thoroughbred control body must invite licensed trainers, racing bookmakers and licensed jockeys to nominate a person for membership of each country racing association. ‘(3) If 1 person is nominated for membership of the country racing association by the licensed trainers, racing bookmakers or licensed jockeys, the person is nominated as the member for part 3, division 1. ‘(4) If more than 1 person (each a nominee ) is nominated for membership of the country racing association by the licensed trainers, racing bookmakers or licensed jockeys, the thoroughbred control body must conduct an election to decide the nominee who is nominated as the member for part 3, division 1.
