Racing (Amendment) Act 1997†

[Assented to 29 April 1997]

The Parliament of Victoria enacts as follows:

1. Purposes

The purposes of this Act are—

(a)

to restructure the Greyhound Racing Control Board; and

(b)

to create the position of chief executive officer of the Board.

2. Commencement

(1) Section 1 and this section come into operation on

the day on which this Act receives the Royal
Assent.

(2) Subject to sub-section (3), the remaining

provisions of this Act come into operation on a

day or days to be proclaimed.

(3) If a provision referred to in sub-section (2) does

not come into operation before 1 July 1997, it

comes into operation on that day.

3. Principal Act

In this Act, the Racing Act 1958 is called the No. 6353.

4. Membership of the Greyhound Racing Control Board In section 69 of the Principal Act, for sub-sections (2), (3) and (4) substitute—

"(2) The Board shall consist of not more than 5

members of whom—

(a) one shall be chairperson;

(b)

at least one and not more than 2 are persons who have experience in business or marketing;

(c)

at least one and not more than 2 are persons who have experience in the greyhound racing industry.

(3) The members of the Board shall be

appointed by the Governor in Council on the
recommendation of the Minister.

(4) The Minister may appoint a member other

than the chairperson to be deputy

chairperson of the Board.

(5) If the chairperson is unable to perform the

duties of the office or the office of
chairperson is vacant, the deputy chairperson
may act in the place of the chairperson.

(6) The deputy chairperson while acting in the place of the chairperson has all the powers and may perform all the duties of the

chairperson.

(7) A member of the Board (other than the

executive director) holding office
immediately before the commencement of
section 4 of the Racing (Amendment) Act
1997 continues to hold office after that
commencement on the same terms and
conditions for the remainder of the term
specified in his or her instrument of

appointment.

(8) A person holding office as executive director

of the Board immediately before the
commencement of section 4 of the Racing
(Amendment) Act 1997 goes out of office

on that commencement.".

5. Term of office

In section 70 of the Principal Act, for sub-sections
(1) and (1A) substitute—
"(1) Subject to this Division, a member of the

Board holds office for the term, not exceeding 3 years, that is specified in the member's instrument of appointment but is eligible for re-appointment.".

6. Chief executive officer

In section 73 of the Principal Act, for sub-sections
(1), (2) and (3) substitute—

"(1) The Board shall appoint, with the approval

of the Minister, a fit and proper person to be

the chief executive officer of the Board.

(2) The chief executive officer is entitled to be

paid—

(a)

the remuneration determined by the Board; and

(b)

travelling and other allowances (if any) determined by the Board, with the approval of the Minister.

(3) The chief executive officer is appointed

subject to any other terms and conditions

determined by the Board.

(3A) The chief executive officer—

(a)

has control of the day to day administration of the affairs of the Board and must administer those affairs in accordance with the policies of, and directions given by, the Board; and

(b)

may exercise other powers and must perform other duties that are conferred or imposed on the chief executive officer by or under this Act or by the Board.

(3B) The Board may, with the approval of the

Minister, revoke the appointment of the chief executive officer at any time.".

7. Consequential amendments

(1) In section 72(1) of the Principal Act, for

"chairman" (where twice occurring) substitute
"chairperson".

(2) In section 72(4) of the Principal Act, for

"chairman of the meeting" substitute "person
presiding at the meeting".

(3) In Schedule 2 to the Public Sector Management

Act 1992 omit—

"Executive Director, Minister for All of Part 4 of
Greyhound Racing Sport, the Act".
