REGULATIONS UNDER THE RABBIT DESTRUCTION
• ORDINANCE 1919 (No. 6 OF 1919). '
BY virtue of the provisions of the Rabbit Destruction C'finance 1919, I, ALEXANDER POYNTON, Minister of State for Hor ^,nd Terri- tories, hereby make the following Regulations, to come into operation on
the first day of January, 1921.

RABBIT DESTRUCTION REGULATIONS. •„
Part I.—Preliminary.
Short Title. 1, These Regulations may be cited as the Rabbit Destruction Regula-
tions. '
Definitions. 2. In these Regulations, unless the contrary intention appears—
" Authorized Officer " means an officer to whom the Minister hasdelegated in writing all or any of his'powers under.the Ordi-
nance ;" Crown Land " means any land vested in the Commonwealth, whether by acquisition or by virtue of the Seat of Government Accep- tance Act, and not held under lease for a longer period than twelve months ;
' " Holding means land held by any person for any estate of freehold or any less estate under the Crown Lands Act of New South Wales, but does not include any land held under lease from the Commonwealth under the Lands Acquisition Act 1906— 1916 or under the Leases Ordinance 1918 ; " Noxious animal " means any animal or bird declared by the Minister
by notice in the Gazette to be a noxious animal;
" Occupier " means the person who is for the time being entitled to
' possession of any holding or land, and includes the resident
manager of the occupier where the occupier is not resident;" Ordinance " means the Rabbit Destruction Ordinance 1919 ;
" Receiver " means an}' person appointed to take delivery 61 scalps ;
or substance shall be made in accordance with,Form 2. " The Minister " means the Minister of State'for Home and Territories.
3. These Regulations are divided into Parts, as follows :—
Part I.—Preliminary. Part II.—Supply of wire netting", &c.
Part III.—Erection of fences.
Part IV.—Groupings of holdings.Part V.—Destruction of noxious animals, &c.
Money to be i- Moneys received from the sale, hire, or renting of any netting, paw into material, machinery, plant, or other substance, shall be paid into the
Consolidated Revenue Fund of the Commonwealth.
Part II.—Supply of Wire Netting, &c.

' °' destruction of rabbits shall be made in accordance with Form 1 and shall be accompanied by a deposit of One pound to cover costs of dealing with the application. If the applicant desires to purchase netting, he shall forward with his application a plan or sketch showing the position of the netting fencing proposed to be erected. 4 (2.) An application to hire such netting, materials, machinery, plant,

| (2.) On receipt of the application, the District Surveyor shall make an inspection and furnish a report to the Surveyor-General as to whether in his opinion the ajjplication should be granted. | |

11.—(1.) If a holder to whom material has been granted under the Procedure in
Ordinance transfers or-conveys his holding, he shall forthwith give notice of bolder,
in writing of this fact on Form 19 (in duplicate) to the District Surveyor,
Canberra.
(2.f If a holder to whom material has been granted under the Ordinance dies, his executors or administrators shall, within fourteen days after the grant of probate* of his will or of letters of administration of his estate, give notice in writing on Form 20 (in duplicate) of such fact, and the name and address of the owner of the holding, to the District Surveyor, Canberra.
(3.) The District Surveyor, on receipt of notice on Form 19 or Form 20, shall—
(aj enter particulars contained in the notice against the entry relating
to the holding in cpaestion ; and
(b) if the holding is subject to a charge to secure, the payment of purchase money and interest for wire netting or other material, machinery, plant, or substances forward a copy of the notice to the Commonwealth Surveyor-General.
| (4.) Any person who fails to furnish a notice as required by this Regulation shall be liable to a penalty not exceeding Ten pounds. |
Part III.—Erection of Fences.
12.—(1.) An application for the determination by a Court of Petty Application for

The Clerk of Petty Sessions by whom the application has been received shall give the applicant and the District Surveyor, Canberra, not less tl ^even days' notice of the time fixed for the hearing of the . application. | |
| (2.) The District Surveyor, on receipt of an application under the last preceding sub-section, shall forward the application to the Common- wealth Surveyor-General, together with a full report. |
13.—(1.) The certificate granted by the Minister to the effect that inspection of any fence which he has caused to be inspected is rabbit-proof shall be in rabbit-proof accordance with Form 13, and shall be issued subject to the fence being of certificate, maintained rabbit-proof, and if at any time subsequent to the issue of
this certificate, the fence be found not rabbit-proof, the certificate shall be
null and void.
• (2.) Evidence that the fence is not rabbit-proof shall not be adduced in any proceeding in which the certificate is prima facie evidence of the fact of the fence being rabbit-proof, unless the opposite party to the proceeding has received at least seven clear days' notice of the in- tention to adduce such e-ndence in contradiction.

Part IV.—Groujtings of Holdings.

15. An application to the Minister for his approval of the inclusion of any'-public iands within a proposed group shall be made in accordance with Form 7, and with the application the applicant shall, furnish a plan or sketch of the whole of the lands proposed to be grouped, showing the position of t i e proposed ring fences and also the position of any other public lands in the immediate neighbourhood of the group. With the plan or sketch the applicant shall also furnish particulars of the lands within the proposed ring fence, distinguishing those which .will, and those which will not, form part ,of the group.

1. Personal Liability.—The purchase money, together wi th interest thereon, shall
be a personal deb t as well as a charge upon t h e holding of the purchaser ; a n d all covenants and condit ions t o be observed by the purchaser shall be binding upon the
_̂ executors, adminis t ra tors , and assigns of such purchaser .
2. Interest on Overdue Instalments.—If default is made in respect of the paymen t of a n y annua l ins ta lment , in teres t shall be pa id on such ins ta lment a t the r a t e of ten per cen tum per annum from the da te appointed for paymen t thereof unt i l the same is paid, and such in teres t shall be added to and be deemed to form par t of such instal- ment .
3. Payment before Due J)ate.—The purchaser shall have the r ight to p a y the whole
or any p a r t of the purchase money a t any t ime before the due da te for paymen t
thereof, wi th interest to the da t e of such p a y m e n t only.
4. Contributions by adjoining Landholders.—The Minister shall have the r ight
to receive, towards p a y m e n t in p a r t or full of any moneys remaining to be paid in connexion wi th the purchase of the net t ing or mater ia ls , any contr ibution payable by an adjoining landholder in respect of such ne t t ing or materials .
5. Maintenance and Repair.—The net t ing and mater ia ls purchased shall be kept
in good repair by the purchaser, and the Minister, by his agents or servants , m a y enter upon the holding a t a n y t ime t o inspect t h e said ne t t i ng or mater ials while any money remains due in respect thereof, and m a y require the purchaser to repa i r t the same, and in default of the purchaser so doing t o the satisfaction of t h e Minister within the t ime specified in a notice in t h a t behalf to be given, the Minister m a y cause such repairs t o be effected a t the cost of the purchaser , and the cost of such repairs when m a d e b y t h e Minister shall be and become a charge upon t h e holding.
6. Insurance.—The purchaser shall, if so directed by .the Minister, insure the
ne t t i ng or mater ials in the n a m e of the Minister, and deliver the policy to the District Surveyor thereof for thwith, and shall punctua l ly p a y all p remiums or other moneys necessary t o keep t h e same insured. All receipts for p remiums shall be forwarded to the Dis t r ic t Surveyor no t more than one day after the due da te for paymen t thereof.
7. Damage or Destruction by Fire.*—In the event of a n y of the net t ing or materials
purchased being damaged or destroyed by fire, t h e purchaser shall immedia te ly so
notify the Distr ic t Surveyor, who shall have the exclusive r ight to receive all moneyspayable under any policy of insurance in respect of such damage or destruction ;
and the Minister may , a t his option, apply the whole or any pa r t of such moneys towardsre-erecting or repairing the said ne t t ing or mater ia ls , or m a y apply the same towards p a y m e n t of any moneys owing to the Minister in respect of the ne t t ing or mater ials ,
no twi ths tand ing t h a t such moneys m a y no t h a v e become due.
8. Failure to Insure.—In the event of any purchaser, who has been directed by
the Minister to insure as aforesaid, failing to keep insured the net t ing or materials purchased, the Minister m a y insure or keep insured sucli ne t t ing or materials , and all moneys pa id b y the Minister in connexion wi th such insurance shall, together with interest thereon a t the ra te of ten per centum per annum, be repaid by the pur- chaser, and unt i l r e p a y m e n t be and become a charge upon the said holding.
9. Powers of the Minister in Default of Payment.—Ji a t a n y t ime the purchaser
makes default in the p a y m e n t of any moneys due t o the Minister in connexion with the purchase of t h e ne t t ing or mater ia ls , or in connexion with the main tenance or repair, or insurance-thereof, the Minister m a y ei ther sue for and recover such moneys or m a y call u p a n d compel p a y m e n t of t h e ' w h o l e " a m o u n t of the purchase money, interest , or other moneys payable in respect of the said purchase, notwi ths tanding t h a t the t ime or t imes appointed for the paymen t thereof m a y no t have arrived, or t ake such other steps t o enforce t h e pharges by these conditions and by the said Ordinance created as m a y seem to "them proper and expedient .
10. Purpose for which Netting, &c, to be used.—The ne t t ing and materials pur-
chased shall be used only for the purpose for which they were supplied by the Minister.
11 . Failure to accept Netting, &c.—In t h e event of t h e appl icant failing or refusing
to accept any ne t t ing ormiater ials applied t o be purchased by him, i t shall be compe- ten t for the Minister to sell such ne t t ing or mater ia l or a n y pa r t thereof to any other person, either by auct ion or otherwise, a t the risk of the applicant .
12. Annual Fee for keeping Account..—An annua l fee of Ten shillings as a charge
for keeping the account of the purchaser shall be paid by h im to the Minister.
13. Delivery of Netting, &c.—Delivery of t h e ne t t ing or o the r materials shall be
deemed to have been made to the purchaser by t h e del ivery thereof on to t rucks a t Queanbeyan ,Ra i lway Stat ion, consigned to the purchaser , and the rai lway receipt is to be deemed conclusive evidence of such delivery. The goods shall thereafter be a t t h e purchaser ' s risk, and all freight and o ther charges shall be paid by him. The charge upon t h e said holding for the p a y m e n t of the purchase money shall be deemed t o have been created as from t h e da t e of such delivery.
