"The Rabbit Boards Aots, 1896 to 1903,"t and this Act may be cited together as "The Rabbit Boards Aats, 1896 to 1905." Amendment 2. In section eleven of the Principal Act, the words of •• 11. "on which not less than one hundred head of cattle or five hundred sheep are ordinarily depastured" are repealed, and the words" which is assessed under this Act on not less than fifty head of cattle or two hundred and fifty sheep" are inserted in lieu thereof; also the words "one hundred" and "five hundred," where they occur in the scale, are repealed, and the words "fifty" and "two hundred and fifty" are respectively inserted in lieu thereof. The following provision is added to the said section ;- For the purposes of this section, where cattle and sheep are being depastured on the same run, all such cattle and sheep shall be taken into account; and for that purpose five sheep shall be deemed to be the equivalent of one head of cattle. • 60 Vic. In the second proviso to section twenty-two of the Amendment Principal Act, the words "one hundred head of cattle or of s. 22. five hundred sheep" are repealed, and the words "fifty head of cattle or two hundred and fifty sheep or a pro- portionate number of cattle and sheep" are inserted in lieu thereof. The following provision is added to the said section :- For the purposes of determining the amount of assessment payable and any question of exemption under this section in cases where cattle and sheep are being depastured on the same run, all such cattle and sheep shall be taken into account; and for that purpose five sheep shall be deemed to be the equivalent of one head of cattle. 4. Section forty-one of the Principal Act is repealed, Amendment and the following section is inserted in lieu thereof :_ of s. 41. [41.J The Minister may, upon the recommendation of the Central Board, cause to be served upon the owner of any run within a District and which is enclosed with wire netting or other appliances for preventing t:/1e passage of rabbits, or is situated within any such enclosure, a notice, in writing, requiring such owner to f0rthwith take effective measures for the destruction of rabbits upon the run. 5. In section forty-two of the Principal Act, the word Amendment " Board" is repealed, and the word "Minister" is inserted of s. 42. in lieu thereof. 6. Section forty-four of the Principal Act is repealed, Amendment and the following section is inserted in lieu thereof :_ of s. 44. [44.] When any person so authorised has incurred any costs, charges, or expenses in taking or destroying rabbits found upon the run, the amount of all such costs, charges, and expenses shall be recoverable from the owner, and payment thereof may be enforced by the Minister or any person authorised by him in the same manner in which the amount of an assessment made under this Act may be recovered and payment thereof enforced by a Board. 7. In the first paragraph of section forty-six of the Amendment Principal Aet, after the words "boundaries of such run," of s. 46. the words " or of affixing wire netting or other appliances to subdivisional fences upon such run" are inserted.

After the first paragraph of section sixty-five of of s. 65. the Principal Act, the following provision is inserted : - The adoption and use of such methods as are ordinarily adopted and used for the purpose of destroying rabbits shall be deemed to be a reasonable exercise of the powers conferred by this Act with reference to the destruction of rabbits, if the person adopting or using such methods exercises ordinary skill and care therein. Preamble. [ASSENTED TO 24TH NOVEMBER, 1905.] W HEREAS it is desirable to amend the laws relating to appeals by employees of the Railway Com- missioner, and to make better provision for the hearing and determination of the same: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title. 1. This Act shall be read and construed with "The Railways Act of 1888"* (herein referred to as the Principal Act) and Acts amending the same, and may be cited as "The Railways (Employees' Appeal) Act of 1905." Constitution 2. (1.) Every appeal which under the Principal Act of Board. and Acts amending the same may be made by an employee to the Commissioner shall hereafter be made to a Board which shall consist of five members-namely, the officers holding for the time being the offices of General Traffic Manager, Chief Engineer, and Locomotive Engineer, a police magistrate to be appointed by the Governor in Council for each of the Divisions of the State, and an employee to be elected for each of the Divisions of the State as hereinafter provided-three of whom shall form a quorum.
