Millhouse J
The application for leave to appeal against sentence by Giovanni Bonfilio has been considered in private by a court consisting of Perry and Nyland JJ and me, in accordance with the rules of the court. The Court is of the opinion that there is no merit in the application: placing significant importance on the fact that the present offences were committed while the prisoner was on home detention. The application is accordingly dismissed.
The Court directs that the parties be advised of this decision and be provided with a record of what has occurred today.

CaseChat Overview and Summary
The legal issues that the court needed to address involved the principles of sentencing, particularly in the context of whether the sentence was proportionate to the crimes committed under the given circumstances. The court was required to assess the relevance of the fact that Bonfiglio was on home detention at the time of the offences and how this should influence the sentencing decision. Additionally, the court had to determine whether the original sentence was just and whether there were grounds for altering it.
Millhouse J, along with Perry and Nyland JJ, concluded that the application for leave to appeal had no merit. The court placed significant importance on the fact that the offences were committed while Bonfiglio was already under home detention, which the court deemed as a critical factor in maintaining the integrity of the original sentence. The court found that the sentence was appropriate given the circumstances and that there were no grounds for altering it. Consequently, the application for leave to appeal was dismissed.
The Court directed that both parties be notified of this decision and provided with a record of the proceedings. This ensures transparency and informs the parties of the court's rationale and the final outcome of the appeal.
