  1. The application for leave to appeal against sentence by Giovanni Bonfilio has been considered in private by a court consisting of Perry and Nyland JJ and me, in accordance with the rules of the court.  The Court is of the opinion that there is no merit in the application: placing significant importance on the fact that the present offences were committed while the prisoner was on home detention.  The application is accordingly dismissed.

  2. The Court directs that the parties be advised of this decision and be provided with a record of what has occurred today.
