CaseChat Overview and Summary

The appeal in *Quinn v Bryant* concerned a dispute between a granddaughter (the respondent) and her grandmother's estate (the appellant). The granddaughter claimed she had relied to her detriment on a promise by her grandmother to provide her with accommodation and to leave her half of the grandmother's estate. The primary judge had found in favour of the granddaughter, assessing compensation on an expectations basis.

The central legal issue before the appellate court was whether the primary judge had erred in failing to consider that the compensation awarded to the granddaughter would be payable before the grandmother's death, thereby "accelerating" the benefit the granddaughter would receive.

The appellate court, comprising Allsop P, Barrett JA, and Sackville AJA, found no error in the primary judge's decision. The court reasoned that the assessment of compensation on an expectations basis, which aimed to place the promisee in the position they would have been in had the promise been fulfilled, inherently encompassed the timing of that fulfillment. The fact that the compensation was payable during the promisor's lifetime, rather than upon her death, did not constitute an error in the assessment of the expected benefit.

Consequently, the appeal was dismissed, and the appellant was ordered to pay the respondent's costs of the appeal.
