108 QueenslandTourist and Travel Corporation Act Anmdt. Act 1981, No. 17 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Queensland Tourist and Travel Corporation Act Amendment Act 1981. (2) In this Act the Queensland Tourist and Travel Corporation Act1979 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Queensland Tourist and Travel Corporation Act1979-1981. 2. Amendment of s. 16. Engagement and employment of staff. Section 16 of the Principal Act is amended by-- (a) in subsection (4), omitting the words '` the Department of Harbours and Marine ", wherever they occur, and substituting in each case the words " the department of the Government of Queensland for the time being concerned with tourism (b) in subsection (6), omitting the words " as if he were such an officer " and substituting the word . accordingly ". 3. Amendment of s. 17. Rights of officers previously employed in Public Service . Section 17 of the Principal Act is amended by- (a) in subsection (2) omitting paragraph (b) and substituting the following paragraph :- " (b) continue to be or, as the case may be. -,hall be deemed to he an officer within the meaning of each of those Acts and shall continue to contribute to that fund and "shall be entitled to payments and other benefits therefrom in respect of himself, his widow and any child of his accordingly."; (b) in subsection (3), omitting from the proviso the words " the Department of Harbours and Marine " and substituting the words " the department of the Government of Queensland for the time being concerned with tourism "; (c) adding at the end thereof the following subsection:- (4) An officer of the Corporation- (a) who was entitled to elect as prescribed by subsection (3): (b) who has continuously performed the duties of' an officer of the Corporation since the appointed day; and (c) whose employment with the Corporation has been terminated by it prior to his attaining the age of' 65 years, shall, upon and by virtue of' such termination, become re-admitted to the Public Service of Queensland and, until he is assigned to a position in another department, shall be an officer in the department of the Government of Queensland for the time being concerned with tourism at the salary classification on which he was employed within the Public Service immediately prior to the appointed day, notwithstanding the provisions of any other Act.

Act 1981, No. 17 109 A termination of employment such as is referred to in paragraph (c) of this subsection shall be taken not to be a dismissal referred to in section 35 of the State Service Superannuation Act1972-1978 and the officer whose employment has been so terminated shall be taken, for the purposes of the Public Service Superannuation Act1958-1978, not to be a person who has ceased to be a contributor. For the purpose of calculating the entitlements to leave of an officer re-admitted to the Public Service under this subsection the period during which he was an officer employed by the Corporation shall be deemed to be service in the Public Service of Queensland and shall be deemed to be continuous with the service in the Public Service of Queensland had by him prior to that period and service in the Public Service of Queensland after his re-admission.". 4. New s. 17A. The Principal Act is amended by inserting after section 17 the following section:-- 17A. Discipline of officers re-admitted to Public Service . ( 1) Subject to subsection (2), a person re-admitted to the Public Service of Queensland under section 17 (4) shall be subject to the provisions of the Public ServiceAct1922-1978 concerning discipline of officers in respect of anything that occurred prior to his being re-admitted to the public Service as it at the time of its occurring he were an officer within the meaning of that Act and he may be charged, suspended from duty, punished or otherwise dealt with as prescribed by those provisions. (2) A person referred to in subsection (I) shall not, by reason of that subsection, be taken- (a) to have been subject to the provisions of the Public ServiceAct1922-1978 at any time while he was employed as an officer of the Corporation except to the extent prescribed by subsection (1); or (b) to be guilty of an offence against the Public Service Act1922-1978 or of a breach of the provisions of that Act on account of anything that occurred at any time while he was employed as an officer of the Corporation.".
