An Act to Make Provision for the Administration of THE QUEENtlLAND "The Queensland Patriotic Fund." PATRIOTIO FUND AOT OF [ASSENTED TO 31sT DECEMBER, 1910.] W 1910. Preamble. HEREAS in the years one thousand eight hundred and ninety-nine and one thousand nine hundred moneys called "Patriotic Funds" were raised throughdut the State by voluntary subscription for relieving such suffering and distress as the Boer War might entail upon. such volunteers from Queensland, and those related to or dependant upon such volunteers, as served in the British Forces in the prosecution of the said war, and for rendering assistance to such volunteers and their relations and dependants as might be found expedient: And whereas in pursuance of a resolution passed at a meeting held at Brisbane on the eighth day of January; one thousand nine hundred, the various patriotic funds aforesaid were amalgamated into one general fund under the name of "The Queensland Patriotic Fund," and were placed under the control and supervision of a General Committee of Management a-ppointed for that purpose: And whereas the said Fund was frqm time to time during the progress of the said war augmented by further subscriptions and donations: And whereas an Executive Committee was appointed on the fifteenth day of January, one thous!),nd nine hundred, by the said General Committee, and the said Executive Committee administered the said Fund subject to control and supervision of the said General Committee: . And whereas the said war came to an end on or about the thirty-first day of May, one thousand nine hundred and two: And whereas at a meeting of the said General Committee held on the thirty-first day of August, one thousand nine hundred and three, it was resolved that, as the said General and Executive Committees had performed the work of inquiry and investigation into the circumstances of the persons for whose assistance the said Fund was established and who had made claims to participate therein. to date, and had distributed the said Fund according to the results thereof, and as there remained,. after making due provision for all proper claims to date, a considerable balance, and as the personnel of the Committees aforesaid had been largely reduced by death, change of residence, and other cau~ es, and as the administration of the sl;.tid Fund might of necessity extend

Queensland Patriotic Fund Act. over a considerable time to come when further changes in the personnel of the Committees aforesaid might naturally be expected to take place, it was desirable that the Com- mittees aforesaid should be dissolved, and that they were, subject as thereinafter provided, dissolved accordingly, and that all their functions were transferred to and vested in certain persons, who were thereby appointed as trustees of the balance of the said Fund, with full power to administer the same, and with power in case of any vacation of office by any of such trustees for the remaining trustees to fill any such vacancy: And whereas since the date last aforesaid the trustees for the time being have duly administered the balance of the said Fund: And whereas the accounts of the said trustees have from time to time been duly audited by officers of the Department of the Auditor-General and. found correct: And whereas there now remains in the hands of the said trustees an unexpended balance of the said Fund, amounting to nine thousand and seventy-two pounds four shillings and one penny, inclusive of interest accrued up to the thirtieth day of November, one thousand nine hundred and ten: And whereas, not- withstanding that the said. Fund has been justly and faithfully administered. by the said. Committees and trustees, doubts may arise as to their powers and. jurisdiction in the premises, and it is expedient to set any such doubts at rest: And. whereas the trustees of the said Fund. are now The Honourable Robert Philp, Alex- ander Stewart, Esquire, and. James William Wassell, Esquire, and. it is expedient to continue them in their said offices, and to make provision for the filling up of any vacancy which may arise in any such office, and to declare the powers of the said trustees and the trusts upon which the said. Fund. shall be held: . Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and. Legis- lative Assembly of Queensland. in. Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited. as "The Queensland Short title. Patriotic Fund Act of 1910." If at any time any vacancy arises in the number of the said trustees by resignation addressed to the Home Secretary, or by failure to attend ,any of three consecutive meetings of the trustees convened during a period of six months, or by death, or other cause, it shall be lawful for the Governor in Council to appoint- another trustee to fill the vacancy so arising. Every such appointment shall be notified in the Gazette. Investment of Fund. 3. The Queensland Patriotic ,Fund shall be invested by the trustees on deposit at the Government Savings Bank, at Brisbane, to the credit of such account or accounts as -5he trustees think fit, and, notwithstanding any Act to the contrary, shall bear interest upon the total . amount thereof at the current prescribed rate of interest. The said }'und shall be held by the trustees upon w ~ h h al ic l hbFe uhnedJd. the t rusts f 0 1 o 1 W ' Ing, name 1 y ; - To apply the Fund and the income thereof, or so much thereof respectively as for the time being remains undisposed of (after payment thereout of all proper expenses of and incidental to the administration thereof) for the relief, assistance, and benefit of such of the volun- teers from Queensland who served in the British Forces in the prosecution of the said Boer War, and of such of the relations and dependants of any such volunteers, and in such manner as the trustees shall, in their unfettered discretion, think fitting, so long as any such persons are, in the judgment of the trustees, entitled to any benefit, 'and also for any public purpose which the trustees, with the previous consent of the Governor in Council, shall think proper. Confirmation 5. All acts and things done and all payments made of p~e~ ious before the passing of this Act respectively by the General : ! ~ l~ riJ: ~ d. Committee of the Queensland Patriotic Fund, and the Executive Committee of the said Fund, and the trustees for the time being of the said Fund, in or in relation to the administration of the said Fund, or in or for the pur- pose of executing the trusts thereof, shall be and are hereby declared to be for all purposes valid and effectual, and are hereby ratified and confirmed, and no trustee aforesaid or person being a member of or acting under the direction or authority of the said General Committee or Executive Committee or trustees, or of any chairman
