WMpa ts1ittth ANNO QUINTO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 1 of 1967 An Act to Amend " The Queensland Marine Acts, 1958 to 1963," in certain particulars [ RESERVED : HER MAJESTY'S ASSENT 30TH JANUARY, 1967: ASSENT PROCLAIMED 2ND MARCH, 1967.] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:- 1. (1) Short title . This Act may be cited as " The Queensland Marine Acts Amendment Act of 1967." (2) Principal Act. " The Queensland Marine Acts, 1958 to 1963 are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Queensland Marine Acts, 1958 to 1967." 1
2 Queensland Marine Acts Amendment Act of 1967, No. 1 2. Commencement . This Act shall not come into operation until after Her Majesty's pleasure herein has been publicly signified in Queensland. After the signification of the said pleasure this Act shall come into operation on a date to be fixed by the Governor in Council by Proclamation published in the Gazette. 3. Amendment of s. 18. Section eighteen of the Principal Act is amended by adding after subsection (8) the following subsections:- " (9) Persons to act as shipping inspectors . The Minister may by notification published in the Gazette appoint under and for the purposes of this Act such and so many persons as deemed necessary to act as shipping inspectors. The powers, functions and duties of an acting shipping inspector- (a) shall be those powers, functions and duties of a shipping inspector specified by the Minister; and (b) shall be published in the notification of appointment. The Minister may from time to time amend the powers, functions and duties, or any of them, of an acting shipping inspector and any such amendment shall be notified in the Gazette. An appointment may be made of a person or persons holding an office without naming the holder or holders of that office; and in every such case each successive holder or, as the case may be, holders of the office in question and each person who for the time being occupies or performs the duties of that office shall be deemed to hold that appointment. Upon publication in the Gazette a notification made pursuant to this subsection shall be judicially noticed and shall be presumed in force until the contrary is proved. (10) Honorary inspectors . The Minister may on the recommendation of the Board by writing under his hand appoint under and for the purposes of this Act such and so many persons as deemed necessary to be honorary inspectors. Every such appointee shall hold office at the pleasure of the Minister. Honorary inspectors shall have such functions and duties as may be determined by the Minister." 4. Amendment of s. 25. Section twenty-five of the Principal Act is amended by omitting subsection (3) and inserting in its stead the following subsection:- " (3) No person shall be examined as aforesaid unless he possesses the prescribed qualifications and is a British subject under and within the meaning of the Nationality and Citizenship Act1948-1960, of the Commonwealth or, for a period of at least one year immediately before the date of the examination, he has been continuously resident in the Commonwealth."
Queensland Marine Acts Amendment Act of 1967, No. 1 5. Amendment of s. 31. Section thirty-one of the Principal Act is amended by omitting subsection (1) and inserting in its stead the following subsection:- (1) Officers to be able to read and write English language. No person shall engage or go to sea as an officer in any passenger coaster or coaster who is not thoroughly conversant with the English language. Penalty: Two hundred dollars."
