95 ANNO VICESIMO OCTAVO ELIZABETHAE SECUNDAE REGINAE No. 9 of 1979 An Act to amend the Queensland Marine Act 1958-1975 in certain particulars [ASSENTED TO 20TH APRIL, 1979] BE IT ENACTED by the Queen's Most Excellent Majesty, by and withthe,advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the, authority of the-same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Queensland Marine Act Amendment Act 1979. (2) In this Act the Queensland Marine Act 1958-1975 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Queensland Marine Act 1958-1979. 2. Commencement of Act. (1) This Act shall not come into operation until after Her Majesty's pleasure hereon has been publicly signified in the State. (2) Subject to subsection (1), this Act shall come into operation on a date fixed by Proclamation. 3. Repeal of s. 124 . The Principal Act is amended by repealing section 124.
96 Queensland Marine Act Amendment Act 1979, No. 9 4. Amendment of s. 128. Section 128 of the Principal Act is amended by, in subsection (1) omitting the words " to which this Part applies ". 5. Amendment of s. 138. Section 138 of the Principal Act is amended by- (a) in paragraph (xiii), inserting after the words " boat drills " the words " , steering tests and drills "; (b) in paragraph (xiv), adding at the end thereof the words " and the display on ships of illustrated tables describing life-saving signals'. 6. Amendment of s. 156. Section 156 of the Principal Act is amended by, in subsection (1), omitting paragraph (vii) and substituting the following paragraph: " (vii) For or in relation to the provision or operation of efficient main and auxiliary steering apparatus and automatic pilot devices.". 7. Amendment of s. 157. Section 157 of the Principal Act is amended by, in subsection (1), omitting the words " any ship " and substituting the words " any coaster, passenger coaster or harbour and river ship ". 8. Amendment of s. 174. Section 174 of the Principal Act is amended by, in subsection (2), omitting provision (ii) and substituting the following provision:- ( ii) Every ship having a length of less than 35 metres measured from the fore part of the hull to the after part of the hull;". 9. Amendment of s. 239. Section 239 of the Principal Act is amended by omitting subsection (2). 10. Amendment of s. 264 . Section 264 of the Principal Act is amended by- (a) adding at the end of subsection (1) the words " or as in his opinion are necessary or desirable for giving effect, in relation to shipping and ships to which this Act applies, to the provisions of treaties, conventions and agreements to the extent that they relate to such shipping or ships or to matters connected with such shipping or ships "; (b) adding to subsection (1) the following paragraph:- " The giving effect to such treaties, conventions and agreements is hereby declared to be within the objects and purposes of this Act.". 11. Extension of application of regulations . (1) Subject to subsection (2), a regulation made before the passing of this Act with respect to any matter specified in a provision of Part VII of the Principal Act shall be taken to apply, upon and after the passing of this Act, in respect of all ships to which that provision of the Principal Act as amended by this Act applies.
Queensland Marine Act Amendment Act 1979, No. 9 97 (2) Subsection (1) does not apply in respect of a regulation that is expressed to apply in respect of a particular class or particular classes of ship.
