This regulation may be cited as the Queensland Law Society (Approval of Indemnity Amendment Rule (No. 1)) Regulation 1994 . ˙ Rule approved 2. The Queensland Law Society (Indemnity) Amendment Rule (No. 1) 1994 set out in the Schedule is approved.

This rule may be cited as the Queensland Law Society (Indemnity) Amendment Rule (No. 1) 1994 . ˙ Amended rule 2. The Queensland Law Society (Indemnity) Rule 1987 is amended as set out in this rule. ˙ Amendment of s 1 3. Section 1, as a heading— insert— ‘ Short title ’. ˙ Amendment of s 1A 4.(1) Section 1A, as a heading— insert— ‘ Definitions ’. (2) Section 1A— insert— ‘ “former practitioner” means a practitioner—

Section 2, as a heading— insert— ‘ Master policy ’. ˙ Amendment of s 3 6. Section 3, as a heading— insert— ‘ Practising practitioners to be insured ’. ˙ Amendment of s 4 7.(1) Section 4, as a heading— insert— ‘ Rule applies to all practising practitioners ’. (2) Section 4(a) and (b)— renumber as subsections (1) and (2) respectively. (3) Section 4— insert— ‘ (3) Subsection (1) does not limit the way in which this rule may apply to a former practitioner.’. ˙ Amendment of s 5 8. Section 5, as a heading—

After section 9— insert— ˙ ‘ Liability of former practitioners ‘ 9A.(1) A former practitioner is liable to pay to the Society any amount owing by the practitioner under any levy determined under section 6, 7 or 9 at the time the practitioner stopped practising. ‘ (2) If a claim, or circumstances that may give rise to a claim, involving a former practitioner comes to the notice of the Council, the former practitioner is liable to pay to the Society an amount by way of practitioner’s deductible as if the former practitioner were still a practising practitioner. ‘ (3) Interest is payable on an amount mentioned in subsection (1) or (2) as if the former practitioner were still a practising practitioner.’. ˙ Amendment of s 10 14. Section 10, as a heading— insert— ‘ Claims Committee ’.
