2 Queensland Law Society (Approval of Indemnity No. 438, 1993 Amendment Rule (No. 1)) ˙ Short title 1. This regulation may be cited as the Queensland Law Society (Approval of Indemnity Amendment Rule (No. 1)) Regulation 1993 . ˙ Approval of rule 2. The Indemnity Amendment Rule (No. 1) 1993 set out in the Schedule is approved.

This rule may be cited as the Indemnity Amendment Rule (No. 1) 1993 . ˙ Amended rule 2. The Indemnity Rule 1987 is amended as set out in this rule. ˙ Replacement of s.1 3. Section 1— omit, insert— ‘1. This rule may be cited as the Queensland Law Society (Indemnity) Rule 1987 . ’. ˙ Insertion of new s.1A 4. After section 1— insert— ‘1A. In this rule— “Chief Executive Officer” means the person holding office as the Society’s Chief Executive Officer; “Director” means the person holding office as the Society’s Director of Law Claims; “Insurance Manager” means the person holding office as the Society’s Insurance Manager. ’.

Section 8(i),(ii),(iii),(iv), (v) and (vi)— renumber as section 8(1), (2),(3), (4), (5) and (6). ˙ Amendment of s.8(6)(b)— 6. Section 8(6)(b)— omit, insert— ‘ (b) amounts payable for the investigation, defence or settlement of a claim made, or circumstances that may result in a claim, against an assured practitioner. ‘(7) An amount payable under subsection (6)(b) may include all or part of the practitioner’s deductible payable under section 9 if 2 of the following persons certify the amount for payment— (a) the President; (b) the Chief Executive Officer; (c) the Insurance Manager; (d) a member of the Claims Committee. ‘(8) A person may refuse to certify an amount under subsection (7) if the assured practitioner has failed to comply with this rule. ‘(9) A person who certifies an amount under subsection (7) may disclose to the Society the information the Society reasonably needs to enable the Society to decide and pay a claim or an account relating to a claim. ’. ˙ Amendment of s.10 7.(1) Section 10(2)— after ‘ The Claims Committee ’, insert ‘ or the Director ’. (2) Section 10(2)— after ‘ the Claims Committee ’ insert ‘ and the Director ’.

5 Queensland Law Society (Approval of Indemnity No. 438, 1993 Amendment Rule (No. 1)) SCHEDULE (continued) (3) Section 10(3)— omit, insert— ‘(3) The Claims Committee or Director may report to the Council— (a) a breach of this rule that, in the Committee’s or Director’s opinion, is relevant to the proper handling or disposal of a claim; or (b) circumstances in which the general exclusion of fraudulent or dishonest acts is invoked or applied under the Certificate of Insurance. ‘(3A) The Claims Committee or Insurance Manager may— (a) report to the Council an assured practitioner’s failure to pay a deductible or levy; or (b) disclose to the Society’s auditor information necessary to enable the auditor to audit the Law Claims Levy Fund. (4) Section 10(4) (1st sentence)— omit, insert— ‘(4) If, in the Committee’s or Director’s opinion, an assured practitioner has an adverse history of claims or liability, the Committee or Director may report particulars of the adverse history to the Council. ’. ˙ Amendment of s.11 8. Section 11(1)— omit ‘ of the Claims Committee pursuant to rule 10 ’, insert ‘ made to it under section 10 ’. ˙ Amendment of s.12 9.(1) Section 12(1)— omit ‘ the Council and the Claims Committee ’, insert ‘ the Council, the Claims Committee and the Director ’.
