QueenslandFilm IndustryDevelopmentAct Amdt Act 1981, No. 94 999 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Queensland Film Industry Development Act Amendment Act 1981. (2) The Queensland Film Industry Development Act 1977-1979 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Queensland Film Industry Development Act1977-1981. 2. Amendment of s. 5. Interpretation . Section 5 of the Principal Act is amended by in the definition " Minister " omitting the words " Culture, National Parks and Recreation " and substituting the words Tourism, National Parks, Sport and the Arts ". 3. Amendment of s. 10 . Powers to discharge functions . Section 10 of the Principal Act is amended by- (a) in subparagraph (b) of subsection (2), inserting after the words " conditions as the " the words " Minister or, as the case may be,"; (b) omitting subsection (3) and substituting the following subsection:- " (3) Financial assistance may be provided by the Corporation under subsection (2)- (a) where the amount of the assistance does not exceed the amount that the Minister is authorized to approve, only with the prior approval of the Minister; (b) in any other case, only with the prior approval of the Governor in Council.". 4. Amendment of s. 12 . Members of Corporation . Section 12 of the Principal Act is amended by in subparagraph (a) of subsection (1) omitting the words " Culture, National Parks and Recreation " and substituting the words " the Arts, National Parks and Sport ". 5. Repeal of and new s. 25. Administrative assistance . The Principal Act is amended by repealing section 25 and substituting the following section:- " 25. Staff . The Corporation may appoint and employ such employees as it thinks necessary to carry out the functions of the Corporation. Those employees shall, subject to any applicable award of any industrial court, commission, tribunal or authority, be appointed and employed on such terms and conditions as to salary and otherwise as the Corporation thinks fit. Such' appointment and employment and such terms and conditions shall be subject to the approval of the Minister.".
1000 Queensland Film Industry Development Act Amdt Act 1981, No. 94 6. Amendment of s. 28. Decision in respect of applications . Section 28 of the Principal Act is amended by- (a) omitting subsection (4) and substituting the following subsection:- " (4) If the Minister is of the opinion that financial assistance should be given to the applicant- (a) he may, if the amount of the assistance does not exceed the amount that he is authorized to approve, approve the application or he may refuse to approve it; or (b) he shall, in any other case, recommend to the Governor in Council accordingly."; (b) in subsection (5), omitting the words " the application " and substituting the words " an application recommended to him pursuant to subsection (4) ". 7. Amendment of s. 34. Restriction on Corporation . Section 34 of the Principal Act is amended by- (a) in subparagraph (c), inserting after the words " by the " the words " Minister or "; (b) in subparagraph (i), (i) omitting the words " such amounts " and substituting the words " such amount as the Minister is authorized to approve or, in any other case , such amounts "; (ii) inserting after the words " approve that " the words " in those other cases ".
