Transferring employees in agreements.

[1] The following decision, now edited, was issued during proceedings on 11 June 2010.

I will indicate that I am satisfied the order should be made and that the requirements have been met. I am satisfied that there is a transfer of business pursuant to section 311 of the Fair Work Act. I am also satisfied that the order can be made under section 318 and that the factors in section 318(3) support the making of the order insofar as those factors are relevant to the situation that is outlined in Mr Johnston's affidavit; so I will make the order. However, I will make the order as required by section 318(4) from the later of those dates: 2 August 2010.
