s1 2 s5 Queensland Building Services Authority Amendment No. 122, 2004 Regulation (No. 2) 2004 1 Short title This regulation may be cited as the Queensland Building Services Authority Amendment Regulation (No. 2) 2004 . 2 Regulation amended This regulation amends the QueenslandBuildingServicesAuthorityRegulation 2003. 3 Amendment of s 5 (Work that is not building work) (1) Section 5(1)(d), after ‘practice’— insert — ‘, including, for example, carrying out a completed building inspection’. (2) Section 5(1)— insert — ‘(zn)assessment of the energy efficiency of a building.’. 4 Amendment of s 6 (Licensed builder—Act, sch 2, definition “licensed builder”) Section 6, from ‘of—’— omit, insert — ‘of a builder contractor’s licence.’. 5 Insertion of new s 6A After section 6— insert — ‘6A Licensed trade contractor—Act, s 42(12), definition “licensed trade contractor” ‘For the Act, section 42(12), definition “licensed trade contractor”, paragraph (c), work within the scope of a builder contractor’s licence is a class of building work.’.
s6 3 s6 Queensland Building Services Authority Amendment No. 122, 2004 Regulation (No. 2) 2004 6 Amendment of sch 2 (Classes of licences and licence requirements) (1) Schedule 2, part 1, section 2(1), ‘sheetmetal and flexible’— omit . (2) Schedule 2, part 5, section 2(1), from ‘other than’— omit, insert — ‘on classes 4 to 9 buildings.’. (3) Schedule 2, part 5, section 2(1) to (3)— renumber as section 2(2) to (4). (4) Schedule 2, part 5, section 2— insert — ‘ (1) Building work on a class 1 or class 10 building.’. (5) Schedule 2, part 7, section 2(1)— omit, insert — ‘ (1) Install, refurbish, restore and repair a kitchen, bathroom or laundry on-site in— (a) a class 1 or class 10 building; or (b) classes 2 to 9 buildings if the gross floor area of the kitchen, bathroom or laundry is not more than 50 m 2 .’. (6) Schedule 2, part 8, section 2(1), ‘, with a gross floor area not exceeding 2 000 m 2 ,’— omit . (7) Schedule 2, part 12, section 2(1), ‘2 or 3’— omit, insert — ‘2, 3 or 9’. (8) Schedule 2, part 18, section 2(1)— omit, insert — ‘ (1) Install, commission, maintain and test plumbing and drainage services in all classes of buildings and premises, including, but not limited to, the following—
s6 4 s6 Queensland Building Services Authority Amendment No. 122, 2004 Regulation (No. 2) 2004 (a) compressed air, heating, steam, vacuum or ventilation systems; (b) irrigation; (c) metal fascias and gutters; (d) on-site domestic waste water management systems; (e) roof and wall cladding; (f) skylights.’. (9) Schedule 2, part 23, section 2(1)— omit, insert — ‘ (1) Install, maintain, repair and certify passive fire equipment (penetration and joint sealing) for which an applicant or licensee is qualified.’. (10) Schedule 2, part 23, section 3— omit, insert — ‘3 Technical qualifications ‘Certification from the manufacturer or supplier of particular passive fire equipment (penetration and joint sealing) that the applicant or licensee is qualified to install the particular passive fire equipment (penetration and joint sealing), in accordance with the manufacturers specifications and the Building Code of Australia.’ (11) Schedule 2, part 23— insert — ‘7 Definitions for pt 23 ‘In this part— “passive fire equipment (penetration and joint sealing)” means a fire block, fire collar, fire joint filler, sealant, mastic, mortar or fire cushion. “qualified” , for an applicant or licensee, means the applicant or licensee has satisfactorily completed a course of instruction about installing particular passive fire equipment (penetration and joint sealing).’. (12) Schedule 2, part 40, section 2(3), after ‘walls’— insert — ‘, including, for example, install skylights and ventilators’.

(14) Schedule 2, part 40, section 3(a)(ii)— omit, insert — ‘(ii) Certificate III in Roof Plumbing BCP30303;’. (15) Schedule 2, part 42, section 3(a)(ii), ‘(Wall and Wall Lining)’— omit, insert — ‘(Wall and Ceiling Lining)’. (16) Schedule 2, part 43, section 2(6) to (10)— renumber as section 2(7) to (11). (17) Schedule 2, part 43, section 2— insert — ‘ (6) Apply trowelled texture-coat finishes.’. (18) Schedule 2, part 44, section 3(a)— omit, insert — ‘(a) successful completion of a Diploma in Engineering (Refrigeration and Air Conditioning) (CN941);’. (19) Schedule 2, part 48, section 3(1)(a)— omit, insert — ‘(a) any 1 of the following— (i) successful completion of Certificate III in Construction Materials (Soil) Testing 30390QLD including the competency Classify Sites CMT4000B; (ii) successful completion of a course the authority considers is at least equivalent to the qualification mentioned in subparagraph (i); (iii) a qualification or statement of attainment issued by an approved authority for the class of licence; and’ .

(21) Schedule 2, part 51, section 2(3) to (6)— renumber as section 2(2) to (5). (22) Schedule 2, part 51, section 3(a), after ‘apprenticeship’— insert — ‘, or traineeship,’. (23) Schedule 2. part 52, section 3(1)(a), ‘a licence under the Health Act1937 , part 4, division 7 7 or’— omit . (24) Schedule 2, part 54, section 2(7)— omit, insert — ‘ (7) Refurbish and maintain roofs, excluding painting roofs. ‘ (8) Incidental work of another class.’. 7 Amendment of sch 3 (Dictionary) (1) Schedule 3— insert — ‘ “passive fire equipment (penetration and joint sealing)” for schedule 2, part 23, see schedule 2, part 23, section 7.’. (2) Schedule 3, definition “builder contractor’s licence”, from ‘means’— omit, insert — ‘means— (a) a licence of a class mentioned in schedule 2, parts 4 to 10; or (b) a housebuilding licence under section 42; or (c) a licence of 1 of the following continuing classes— (i) building restricted to alterations and additions; (ii) building restricted to external finishes; (iii) building restricted to building removal;
