This Act may be cited as "The Queensland Short title. Border to South Brisb: ~ lne Railway Management Act Amendment Act of 1936," and shall be read as one with *" The Queensland Border to South Brisba,ne Railway Management Act of 1930," herein referred to as the Principal Act. The Principal Act and this Act may be collectively cited as "The Queensland Border to South Brisbane Railway Management Acts, 1930 to 1936." * 21 Geo, V. No. 3, supra, page 13281.

The Principal Act is hereby amended by the insertion therein, after section five, of the following new section numbered 5A, namely : - Rights of " [5A.] (1.) Any :person transferred from the service e r ~ m lp w lo a y y ete o s on of . the Commission . er for Ra • ilways of Q . ue , ensland to the transfer to RerVICe of or provIded by hIm for serVIce WIth the Com- ?rtPhromotioD missioner for Railways of New South Wales under and t Q U ueeensland.III pursuance of t h e agreement or any amen d ment ~ : ~: ; . thereof .(and whethe.r such person was so transferred or provIded for serVICe before, on, or after the passing of *" The Queensland Border to South Brisbane Railway Management Act Amendment Act of 1936") and being in the service of the Commissioner for Railways of New South ·Wales otherwise than in a temporary capacity shall if and as provided in the agreement or any amend- ment thereof (and whether so provided before, on, or after the passing of *" The Queensland Border to South Brisbane Railway lYIanagement Act Amendment Act of 1936 ") be deemed to remain or to become and to be eligible in accordance with the provisions of subsection two of this section for transfer to andlor promotion in the service of the Commissioner for Railways of Queens- land, and may at any time while he is so eligible be so tmnsferred to that service or may apply for any vacancy in that service for which he is qualified in other respects. (2.) The place in mnk, position, or grade of any person eligible for transfer or prumotion in terms of subsection one of this section in relation to other employees or to any vacancy in the service of the Commissionel for RaiIwDoYs of Queensland shall be determined as if the whole of his service both with the Commissioner for Railways of Queensland and with the Commissioner for Railwavs of New South 'Vales under and in pursuance of the Vagreement or any amendment thereof had been under the Commis.3ioner for Railways of Queensland, and as if the payment received for the service with the Commissioner for Railways of New South \Vales had been at the rates from time to time applicable to similar service with the Commissioner for Railways of Queensland, but promotion in the service of the Commissioner for Railways of New South 'Vales * This Act.

(Jueenslanrl Border to South Brisba.ne, Etc., Act. - - - - - - - - - - ---------------------------------- shall not be taken into account, and if any such person shall have been disrated whilst in the employ of the Commissioner for Railways of New South Wales such disrating shall be deemed to have been suffered in the service of the Commissioner for Railways of Qneensland. Any person eligible for promotion under this section shall for the purpose of appealing or being appealed against in respect of any vacancy for which he has applied be and be deemed to be an employee of the Commissioner for Railways of Queensland." 16335 REGULATION OF SUGAR CANE PRICES AMENDMENT.
