256 (Qitanslttxtr ANNO VICESIMO OCTAVO ELIZABETHAE SECUNDAE REGINAE No. 29 of 1979 An Act to amend the QueenslandArt Gallery Act of 1959, the QueenslandMuseum Act1970- 1974 and the Queensland PerformingArts Trust Act 1977 each in certain particulars [ASSENTED TO 8TH JUNE, 1979] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the Queensland Art Gallery Act and Other Acts Amendment Act 1979. 2. Arrangement of Act. This Act is arranged as follows:- PART I-PRELIMINARY; PART II-AMENDMENTS OF THE QUEENSLAND ART GALLERY ACT OF 1959; PART III-AMENDMENTS OF QUEENSLAND MUSEUM ACT 1970-1974; PART IV-AMENDMENTS OF QUEENSLAND PERFORMING ARTS TRUST ACT 1977.

QueenslandArt Gallery Act and Other Acts Amdt Act 1979, No. 29 257 PART II-AMENDMENTS OF THE QUEENSLAND ART GALLERY ACT OF 1959 3. Citation . ( 1) In this Part, The Queensland Art Gallery Act of 1959 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Queensland Art Gallery Act 1959-1979. 4. Amendment of s. 3 . Section 3 of the Principal Act is amended by omitting the definition " Minister " and substituting the following definition:- _ " " Minister "-The Minister for Culture, National Parks and Recreation or other Minister of the Crown who, at the material time , is charged with the administration of this Act and includes a Minister of the Crown who is temporarily performing the duties of the Minister;". 5. Amendment of s. 4 . Section 4 of the Principal Act is amended by omitting subsection (4) and substituting the following subsection:- " (4) One of the trustees shall be 'the permanent head for the time being of the department of the Government of the State by which the Minister administers this Act or the permanent head's nominee,". 6. Amendment of s. 5. Section 5 of the Principal Act is amended by omitting from subparagraph (e) of subsection (1) the words " hold- any of the offices mentioned in that subsection " and substituting the words " be a person to whom that paragraph relates ". 7. New s. 8A. The Principal Act is amended by inserting after section 8 the following section:- " 8A. Allowances . (1) Subject to subsections (2) and (3), each trustee shall be paid such allowances, if any, as the Minister from time to time determines. (2) Allowances shall not be paid to a trustee who is an officer of the Public Service of Queensland for attendance at any meeting of the trustees held during ordinary office working hours of that officer. (3) Allowances shall not be paid to a trustee who is a Judge of the Supreme Court.". PART III-AMENDMENTS OF QUEENSLAND MUSEUM ACT 1970-1974 8. Citation . (1) In this Part, the Queensland Museum Act1970-1974 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Queensland Museum Act1970-1979.

Section 3 of the Principal Act is amended by- (a) inserting after the definition " chairman " the following definition:- " DDepartmmeenntt " means the department of the Government of the State by which the Minister administers this Act;"; (b) omitting the definition " Minister " and substituting the following definition:- " " Minister "-The Minister for Culture, National Parks and Recreation or other Minister of the Crown who, at the material time, is charged with the administration of this Act and includes a Minister of the Crown who is temporarily performing the duties of the Minister;". 10. Amendment of s. 4 . Section 4 of the Principal Act is amended in subsection (5) by-11 (a) omitting paragraph (a) and substituting the following paragraph:- (a) the permanent head for the time being of the Department or the permanent head's nominee;"; (b) omitting the words " , subject to section 5 of this Act,". 11. Repeal of and new s. 5. The Principal Act is amended by omitting section 5 and substituting the following section:- " 5. Secretary and Chief Executive Officer . The Director of the Queensland Museum shall be the secretary and Chief Executive Officer of the Board.". 12. Amendment of s. 7. Section 7 of the Principal Act is amended by omitting the words " the Director-General of Education or his nominee " and substituting the words " the person appointed under paragraph (a) of subsection (5) of section 4 ". 13. Amendment of s. 8 . Section 8 of the Principal Act is amended by omitting the words " the Director-General of Education or his nominee " and substituting the words " the person appointed under paragraph (a) of subsection (5) of section 4 ". 14. Amendment of s. 19. Section 19 of the Principal Act is amended by omitting from subsection (2) the words " (other than the ex officio member) ". 15. New s. 21A. The Principal Act is amended by inserting after section 21 the following section:- " 21A. Allowances. (1) Subject to subsection (2), each member shall be paid such allowances, if any, as the Minister from time to time determines. (2) Allowances shall not be paid to a member who is an officer of the Public Service of Queensland for attendance at any meeting of the trustees held during ordinary office working hours of that officer.".

Queensland Art Gallery Act and Other Acts Amdt Act 1979, No. 29 259 16. Amendment of s. 31. Section 31 of the Principal Act is amended by omitting the words " of Education ". 17. Amendment of s. 34 . Section 34 of the Principal Act is amended by- (a) omitting from subsection (1) the words " Director-General of Education " and substituting the words " the permanent head for the time being of the Department "; (b) in subsection (2)- (i) omitting the words " Director-General of Education, and the Director-General of Education " and substituting the words " permanent head for the time being of the Department, and the permanent head "; (ii) omitting the words " Department of Education " and substituting the word " Department "; (c) omitting from subsection (4) the words " Director-General of Education " and substituting the words " permanent head for the time being of the Department ". 18. Amendment of s. 35. Section 35 of the Principal Act is amended by omitting from subsection (1) and from subsection (2) the words " Director-General of Education " and substituting the words " permanent head for the time being of the Department " in each case. PART IV- AMENDMENTS OF QUEENSLAND PERFORMING ARTS TRUST ACT 1977 19. Citation . ( 1) In this Part, the QueenslandPerforming ArtsTrust Act1977 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Queensland Performing Arts Trust Act1977-1979. 20. Amendment of s. 3. Section 3 of the Principal Act is amended by- (a) inserting after the definition " Chairman " the following definition:- Departmental head " means the permanent head for the time being of the department of the Government of the State by which the Minister administers this Act;"; (b) omitting from the definition " Minister " the words " Education and Cultural Activities " and substituting the words " Culture, National Parks and Recreation.". 21. Amendment of s. 6. Section 6 of the Principal Act is amended by omitting from paragraph (a) the words " Director-General of Education " and substituting the words " Departmental head ". 22. Amendment of s. 12. Section 12 of the Principal Act is amended by omitting the words " Director-General of Education " and substituting the words " Departmental head ".
