Application for approval of the Qube Specialised Logistics Queensland Enterprise Agreement 2015.
[1] An application has been made for approval of an enterprise agreement known as the Qube Specialised Logistics Queensland Enterprise Agreement 2015 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Qube Logistics (SL) Pty Ltd T/A Qube Logistics. The Agreement is a single-enterprise agreement.
[2] The application was made on 18 January 2016. The Form F17 Statutory Declaration filed with the application states that the Agreement was made on 21 December 2015. The application was not lodged within 14 calendar days of the Agreement being made, as required by s.185(3)(a) of the Act. The explanation provided in the Statutory Declaration is that the timing of the vote falling in the week prior to Christmas and the subsequent holiday period, and the posting of the Agreement from Sydney to Brisbane for signing, resulted in the application not being lodged within the 14 day timeframe. In accordance with s.185(3)(b), it is considered fair in all of the circumstances to extend the time for making of the application to 18 January 2016, the date the application was lodged.
[3] The Transport Workers’ Union of Australia, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2), I note that the Agreement covers this organisation.
[4] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act, as are relevant to this application for approval, have been met.
[5] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 7 days after the agreement is approved, that is, 12 February 2016. The nominal expiry date of the Agreement is 30 June 2018.
