  1. Name of Determinations [see Note 1]

These Determinations are the Quarantine Service Fees Determinations 2001.

Note   These Determinations take effect on the day on which the notice of the Determinations is published in the Gazette — see Act, subsection 86E (3).

  1. Definitions

In these Determinations, unless the contrary intention appears:

Act means the Quarantine Act 1908.

AQIS means the Australian Quarantine and Inspection Service.

Australian Customs Services entry management system means the computerised import control system used by the Australian Customs Service and AQIS.

ICON means the AQIS import conditions database.

in-office, in relation to the performance of a service, means the performance of the service at a location where AQIS services are permanently available.

intake period in respect of an equine animal means the period commencing when the animal arrives at a quarantine station and ending when the official quarantine period commences.

item means an item in the Schedule.

official quarantine period in respect of an equine animal means the 14 day period, or such longer period as the Director of Quarantine specifies, ending immediately prior to the animal being released from quarantine, during which no other equine animal arrives at the quarantine station.

Note   The terms basic fee, late payment fee and payment day used in these Determinations are defined in section 86E of the Act.

  1. Fees payable for services

Subject to clauses 4 and 5, the fee payable in respect of a service specified in column 2 of an item is the amount set out in, or ascertained in accordance with, column 3 opposite the description of that service.

  1. Minimum fee

When a fee in column 3 is expressed as a minimum fee, the fee payable is not less than the amount specified.

  1. Multiple fees

When more than one fee in column 3 is applicable to a service, the fee payable is to be calculated by adding together the fees that are applicable to that service.

  1. Due date for payment

A fee imposed by these Determinations is to be paid:

(a)    if the amount of the fee is determined before the provision of the service — on demand for payment; or

(b)    in any other case — on the due date shown on an invoice issued by the Australian Quarantine and Inspection Service.

  1. Late payment fee

(1)   If the basic fee is not paid on or before the payment day for the fee, a late payment fee is payable in accordance with subclause (2).

(2)   The late payment fee is :

0.2 × basic fee × days overdue

where days overdue is the number of days after the payment day and before the day on which the basic fee is paid.

  1. Determinations do not apply to certain services

These Determinations do not apply in relation to services provided:

(a)    to diplomatic staff of a country other than Australia;

(b)    to foreign vessels and equipment undertaking combined exercises with the Australian defence forces;

(c)    for examination of personal luggage arriving in Australia aboard the same vessel as the owner or importer of the goods; or

(d)    for surveillance of parcel post items containing goods that are for private/non-commercial use.

  1. Revocation of previous determinations

These Determination revoke all previous determinations made under section 86E of the Act, with the exception of the Quarantine Service Fees 2000-03 (Australia Post) Determination 2000.

4 Surveillance, inspection and treatment of High Volume Low Value (HVLV) air cargo consignments

in addition to the fee set out in item 2 or 3, for each sea or air cargo entry lodged on the Australian Customs Service entry management system by a person registered as a ‘special reporter’ under Division 3 of Part IV of the Customs Act 1901:

   (a)  $4; or

   (b)  during the period 12 January 2004 to 11 January 2005 inclusive — $2.50

Clearance of a sea container unit (not empty container)

   (a)  if the fee is paid by the owner of the container or an agent of the owner, for each clearance performed:

         (i)   $15 per container; or

        (ii)   during the period 12 January 2004 to 11 January 2005 inclusive — $9.50 per container

   (b)  if the fee is paid by the owner of the imported goods or an agent of the owner, for each clearance performed:

         (i)   $15 per container (full container load of cargo) or $3.75 per container (less than a full container load of cargo); or

        (ii)   during the period 12 January 2004 to 11 January 2005 inclusive — $9.50 per container (full container load of cargo) or $3.75 per container (less than a full container load of cargo)

Processing of a quarantine entry directly following initial lodgment

   (a)  for each entry lodged — $35.50 per quarter hour or part thereof; or
   (b)  for each entry lodged during the period 12  January 2004 to 11 January 2005 inclusive — $14 per quarter hour or part thereof
7 For container (tailgate) inspections performed in-office, or at a quarantine approved premises where inspection services are permanently available $35.50 per container
8 For other container (tailgate) inspections $80 for the first container recorded on an entry and therefore $40 per container
9 For fumigation monitors performed in-office, or at a quarantine approved premises where inspection services are permanently available

C.      Plants — care and testing

Care and maintenance of a plant or plants in quarantine at a quarantine station referred to in paragraph 15(a) or (b) of the Quarantine Proclamation 1998:

(a)     being a plant or plants grown from imported seed the import permit in relation to which required the plant or plants to be grown in quarantine to maturity

$1.23 per day for each square metre (or part) of space occupied by the plant or plants at the quarantine station

(b)     being a plant or plants the import permit in relation to which specified that quarantine be performed for more than three months

$1.23 per day for each square metre (or part) of space occupied by the plant or plants at the quarantine station
(c)     being any other plant or plants $2.57 per day for each square metre (or part) of space occupied by the plant or plants at the quarantine station

For the following services provided by AQIS in respect of a plant or plants in quarantine:

(a)     microscopic examination

$60 per examination

(b)     testing by electron microscopy $100 per test
(c)     fungal identification $100 per test
(d)     bacterial identification $150 per test
(e)     nematode identification $125 per test
(f)     serological testing

11 or more tests — $60 per test

6 to 10 tests — $75 per test

2 to 5 tests — $90 per test

1 test — $100

(g)     molecular testing $145 per test
(h)     double stranded RNA testing $745 for each group of 10 or fewer tests
(i)      any other biochemical testing $150 per test
(j)      testing by using herbaceous indicator plants $70 per test
(k)     testing by using woody indicator plants $150 per test
(l)      disease elimination by shoot tip culture $1250 per test
(m)    disease elimination by heat therapy $2500 per test
29A Services referred to in item 29 that AQIS has arranged be provided at a facility not managed by AQIS

D.      Animals — quarantine station

30 Use of a quarantine station for management of animals:
(a)     an equine animal or ruminant animal:
         (i)   equine animal, care and maintenance provided by importer during the official quarantine period for the animal, $34 per animal per day for the first 25 animals, plus

$10 per day for each animal in excess of 25 with feed and veterinary supplies to be provided by the importer

        (ii)   cattle and alpaca, care and maintenance provided by importer $34 per animal per day, for the first 25 animals, plus

$3 per day for each animal in excess of 25 with feed and veterinary supplies to be provided by importer

(b)     use of grooms quarters with cleaning to be carried out by importer

during the intake period for the animal, $10 per person per day

during the official quarantine period for the animal, $150 per week or part thereof, plus $10 per person per day

once the animal has been released from quarantine, $31 per person per day

(c)     cats and dogs:
         (i)   cat that is 6 weeks or more old $12 per day for the first animal in a consignment, plus

$9 per animal per day for each animal in excess of one

        (ii)   dog that is 6 weeks or more old $16 per day for the first animal in a consignment, plus

$11 per animal per day for each animal in excess of one

(d)     a bitch that whelps $400 for the first 7 hours or less of supervision, plus

$19 per hour for each additional hour of supervision, plus

up to $5 per day for each pup up to 6 weeks, plus

the daily rate

(e)     a cat that has kittens $300 plus the daily rate
(f)     a rabbit or a guinea pig $5 per day
(fa)    a queen bee; with all reproductive management and the nucleus colony provided by the importer.  Fee includes AQIS entomological testing and technical officer services for the first 2 months of quarantine for a consignment of queen bees, to a maximum of 12 queen bees:

         (i)   weighing not more than 60 kilograms $16 per day

        (ii)   weighing in excess of 60 kilograms

$34 per day for the first 25 animals plus

$10 per day for each animal in excess of 25 with feed and veterinary supplies to be provided by importer

(i)      conveyance of cats and dogs to Government quarantine stations $95 per importer per journey within normal business hours, and $120 per importer per journey after hours

E.       Shift work and overnight

31 When services are performed outside an officer’s usual hours of duty, or an officer is required to perform shiftwork, an additional fee will be charged calculated at the following rates:
(a)     time and a half:
         (i)   for veterinary officers $10.60 for each ¼ hour or part thereof. A minimum fee of $183 applies when the services are performed non-continuously with ordinary duty
        (ii)   for other officers $8.30 for each ¼ hour or part thereof.  A minimum fee of $144 applies when the services are performed non-continuously with ordinary duty
(b)     double time:
         (i)   for veterinary officers $14.10 for each ¼ hour or part thereof. A minimum fee of $226 applies when the services are performed non-continuously with ordinary duty
        (ii)   for other officers $11 for each ¼ hour or part thereof.  A minimum fee of $177 applies when the services are performed non-continuously with ordinary duty
(c)     double time and a half:
         (i)   for veterinary officers $18 for each ¼ hour or part thereof. A minimum fee of $282 applies when the services are performed non-continuously with ordinary duty
        (ii)   for other officers $14 for each ¼ hour or part thereof.  A minimum fee of $222 applies when the services are performed non-continuously with ordinary duty
(d)     for the performance of shiftwork by veterinary officers:
         (i)   for shiftwork performed on a Monday, Tuesday, Wednesday, Thursday or Friday which is not a holiday $1 per quarter hour
        (ii)   for shift work performed on Saturday $3.50 per quarter hour
       (iii)   for shift work performed on Sunday $7 per quarter hour
       (iv)   for shift work performed on a public holiday during normal hours $10.60 per quarter hour
        (v)   for shift work performed on a public holiday outside normal hours $17.60 per quarter hour
(e)     for the performance of shiftwork by other officers:
         (i)   for shiftwork performed on a Monday, Tuesday, Wednesday, Thursday or Friday which is not a holiday $0.70 per quarter hour
        (ii)   for shift work performed on Saturday $2.30 per quarter hour
       (iii)   for shiftwork performed on Sunday $4.70 per quarter hour
       (iv)   for shiftwork performed on a public holiday during normal hours $7 per quarter hour
        (v)   for shiftwork performed on a public holiday outside normal hours $11.80 per quarter hour
32 Overnight costs when an officer is required to stay overnight in order to perform services $120 per night

F.       Registration of premises

33 Application for approval, or for renewal, of registration of premises for the purposes of performing quarantine $800 plus $80 for the first half hour or part thereof for each officer performing the service (for inspection of premises and examination of documentation) and thereafter $40 per quarter hour or part thereof for each officer performing the service

G.      Stowage of goods

34 Stowage of goods not removed from premises owned or managed by AQIS after clearance through quarantine:
(a)     seeds if not removed within 7 days of quarantine clearance $9.60 per kilogram or part thereof
(b)     plants including bulbs, corms, rhizomes or tubers if not removed within 7 days of quarantine clearance $2.40 per plant per day or part thereof
(c)     machinery or other equipment (including motor vehicles) if not removed within 7 days of quarantine clearance) $66 per unit per day or part thereof
(d)     animals following completion of the mandatory quarantine period continue daily management rate according to species as specified in item 30
(e)     other goods if not removed within 7 days of quarantine clearance $12 per cubic metre per day or part thereof
(f)     care and maintenance of goods held for passengers on in-transit flights $30 per passenger

H.      Seaports and airports

35 Routine examination and clearance at first and subsequent seaports of call in Australia for each entry of:
(a)     granting of pratique:
         (i)   with inspection of non-aircraft vessels in excess of 25 metres overall length $680 plus
$34 for each quarter or part thereof in excess of 1.5 hours of inspection for each officer performing the service
        (ii)   with inspection of non-aircraft vessels 25m or less in overall length $132 for the first hour or part thereof for each officer performing the service, then
$34 for each additional quarter hour or part thereof for each officer performing the service
(b)     follow-up inspections $68 for the first half hour or part thereof for each officer performing the service, plus
$34 for each additional quarter hour or part thereof for each officer performing the service
36 Deratting certificate when not performed in conjunction with first port of call inspection $68 for the first half hour or part thereof for each officer performing the service, plus
$34 for each additional quarter hour or part thereof for each officer performing the service
37 Performance of a non-aircraft vessel related service for which a fee is not set out in item 35 or 36:
(a)     for inspections or any other quarantine service $68 for the first half hour or part thereof for each officer performing the service, plus
$34 for each additional quarter hour or part thereof for each officer performing the service
(b)     for the services of each inspector whose services are required for a normal working day $605 per day
(c)     for the services of each inspector whose services are required during normal working hours for a week $2,107 per week
38 Routine examination and clearance at first approved landing place in Australia:
(a)     for in-office inspections $32 per quarter hour or part thereof for each officer performing the service
(b)     for other inspections $72 for the first half hour or part thereof for each officer performing the service and thereafter

$36 per quarter hour or part thereof for each officer performing the service

(c)     for the services of each inspector whose services are required for a normal working day $637 per day
(d)     or the services of each inspector whose services are required during normal working hours for a week $2,218 per week
