  1. Name of Determination

This Determination is the Quarantine Service Fees Amendment Determination 2008 (No. 2 ).

  1. Amendment of Quarantine Service Fees Determination 2005

Schedule 1 amends the Quarantine Service Fees Determination 2005.

3              Commencement

This Determination commences on the day after it is registered.

3              Transitional

The amendments made by Schedule 1 apply in relation to a service provided on or after the day on which this Determination commences.

(section 3)

[1]           Section 5, definition of ACA

substitute

application, in relation to a permit, means an application for a permit or an application for a variation of a permit.

[2]           Section 5, definitions of assessable item and COMPILE

substitute

assessable item means each item on an application for a permit, or on an application for the variation of a permit, that identifies the importation or proposed importation of goods, or a class of goods, from a particular country for a particular use.

assessment fee means a fee set out in column 3 of Division 2 of Part 1 of Schedule 1.

electronic lodgment of an application means lodgment of an application using an AQIS electronic import permit application system.

entry means:

(a)    an entry lodged electronically or manually on an AQIS entry management system for the purpose of giving notice under subsection 16AC (1) or (2) of the Act; or

(b)    an entry lodged on ICS.

full import declaration means an entry lodged on ICS that contains the information mentioned in the table in subregulation 50 (2).

(a)    a full import declaration; or

(b)    a self-assessed clearance declaration.

initial assessment period, for an application, means the first-mentioned period in column 3 of items 23 to 26 in Division 2 of Part 1 of Schedule 1.

lodgment fee means a fee set out in column 3 of Division 1A of Part 1 of Schedule 1.

[5]           Section 5, definition of permit application

permit means a permit mentioned in section 13 of the Act.

self-assessed clearance declaration means an entry lodged on ICS that contains the information mentioned in the table in subregulation 51 (2).

service means the doing of anything in connection with:

(a)    a quarantine service; or

(b)    anything referred to in paragraph 86E (1) (e) or (f) of the Act.

[7]           Subsection 6 (1)

(1) For section 86E of the Act, and subject to sections 7, 8, 8A, 8B and 8C of this Determination, the fee payable for a service mentioned in column 2 of an item in Schedule 1 is:

(a)    the amount set out in, or worked out in accordance with, column 3 of the item for the service; and

(b)    any additional fee imposed under subsection (2), (3) or (4).

8              Due date for payment of fees

(1)   Subject to sections 8A, 8B and 8C of this Determination, a fee imposed by this Determination must be paid:

(a)    if the fee relates to a quarantine service for which the fees can be worked out before the provision of the quarantine service, and the amount of the fee is determined before the quarantine service is provided — on demand for payment; or

(b)    in any other case — by the close of business on the last day for payment of the fee shown on an invoice issued by AQIS.

(2)   A demand for payment must not be made unless the intended recipient of the quarantine service, or the person’s agent, has been informed of the amount of fees payable.

(3)   If a fee is required to be paid before the quarantine service is provided, a quarantine officer may withhold the provision of the quarantine service until the fee is paid.

8A           Payment of fees for lodgment and assessment of applications

(1)   The lodgment of an application must be accompanied by:

(a)    the appropriate lodgment fee; and

(b)    the appropriate assessment fee for the initial assessment period. 

(2)   If the assessment of an application takes longer than the initial assessment period, an additional assessment fee is payable.

(3)   An additional assessment fee is worked out in accordance with column 3 of the relevant item in Division 2 of Part 1 of Schedule 1.

8B           Payment of fees for lodgment and assessment of entries

The lodgment of an entry must be accompanied by:

(a)    the appropriate lodgment fee; and

(b)    the appropriate assessment fee.

8C           Persons by whom fees are payable

Fees payable under this Determination are payable:

(a)    for the lodgment of an application or entry— by the person who lodges the application or entry; and

(b)    for any other service — by the person to whom the service is, or is to be, provided.

A product to which a compliance agreement applies; canned pet food; a cell line derived from laboratory animals; cats or dogs, other than the first cat or dog in a consignment; cosmetics; cut flowers; dried herbs, dried spices; food items for human consumption; fruit; herbarium specimens not infected or infested; hides or skins; human therapeutics (private and commercial); human vaccines; laboratory material (proteins, DNA, animal sera); microbes; natural fibres and fibre products; non-organic fertiliser (bulk); plant-based stockfeed samples for in-vitro use; plant material, seeds or grains, or both, for in-vitro use; seeds or grains for processing or human consumption or both; a cell line derived from a non-laboratory animal; a fermented product that is not a veterinary therapeutic product or a stock food product; a parasite; soil samples; vegetables; water

For each assessable item:

   (a)  for an initial assessment period up to 1 hour — $80; and

   (b)  for each quarter hour, or part of a quarter hour, after the initial assessment period — $35.50

Assessment of an application for a permit, or variation of a permit

 — for any of the following non-standard goods (Category 3):

Herbal teas; herbarium specimens infected and infested; oversized timber that is not for milling; plant material and seeds or grains for in-vitro use (infected or infested); plant pollen for in-vivo use; a micro-organism (possible pathogen); aquaculture feed or bait; wood chips or charcoal for cooking or smoking food

For each assessable item:

   (a)  for an initial assessment period up to 2 hours — $140; and

   (b)  for each quarter hour, or part of a quarter hour, after the initial assessment period — $35.50

Assessment of an application for a permit, or variation of a permit

 — for any of the following non-standard goods (Category 4):

Animal reproductive material; biological control agent; bird seed; live animals, including the first cat or dog in a consignment, but not subsequent cats or dogs in a consignment; plant-based stock feed; plant pathogens for in-vivo or in-vitro use; seed or plant material for processing into pet food; bulk culture (medium); dried pet food; organic fertiliser

For each assessable item:

   (a)  for an initial assessment period up to 3 hours — $200; and

   (b)  for each quarter hour, or part of a quarter hour, after the initial assessment period — $35.50

Assessment of an application for a permit, or variation of a permit

 — for any of the following non-standard goods (Category 5):

Biological material for in-vivo use; a single new master seed; an additional new master seed which is part of a live or inactivated veterinary vaccine; a single new veterinary vaccine that is live or inactivated with a single master seed; a single veterinary vaccine renewal that is live or inactivated
