1  Name of determination

This determination is the Quarantine Service Fees Amendment (2014 Measures No. 1) Determination 2014.

2  Commencement

This determination commences on 1 July 2014.

3  Authority

This determination is made under the Quarantine Act 1908.

4  Schedule(s)

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Part 1—General amendments

Quarantine Service Fees Determination 2005

1  Subsection 5(1)

Repeal the following definitions:

(a)  definition of AQIS;

(b)  definition of AQIS entry management system;

(c)  definition of AQIS holiday.

2  Subsection 5(1)

Insert:

Customs has the meaning given by section 4AA of the Customs Administration Act 1985.

3  Subsection 5(1)

Insert:

Departmental entry management system means an electronic import control system maintained and administered by the Department.

Departmental holiday, for the performance of a service, means a Monday, Tuesday, Wednesday, Thursday or Friday that:

(a)  is a day observed as a public holiday in the place where the service is performed; or

(b)  falls in the period beginning on 27 December and ending on 31 December in a year.

4  Subsection 5(1) (definition of ICS)

Repeal the definition, substitute:

ICS (short for Integrated Cargo System) means the system of that name administered by Customs.

5  Subsection 5(1)

Insert:

kitten means a cat that is less than 12 weeks old.

pup means a dog that is less than 12 weeks old.

6  Subsection 7A(1)

After “38B”, insert “, 38C or 38D”.

7  Paragraph 7B(1)(a)

Omit “38C”, substitute “38E or 38F”.

8  Part 1 of Schedule 1 (table item 32, column 3)

Omit “item 36”, substitute “items 36 to 38”.

9  Part 3 of Schedule 1 (table item 36)

Repeal the item, substitute:

36	For holding a ruminant or camelid animal in quarantine at a quarantine station and performing services in relation to the animal (not including care and maintenance or the provision of feed or veterinary supplies)	$25.00 a day for each animal
36A	For holding an equine animal in quarantine at a quarantine station and performing services in relation to the animal (not including care and maintenance or the provision of feed or veterinary supplies)	$262.00 a day for each animal
36B	For holding a cat in quarantine at a quarantine station and performing services in relation to the cat	$149.00 a day for each cat
36C	For holding a cat that bears kittens while in quarantine at a quarantine station	In addition to the fee under item 36B—$1 500.00
36D	For holding one or more kittens in the litter of a cat in quarantine at a quarantine station and performing services in relation to the kittens	$11.00 a day per litter (if the kittens are born in quarantine, this fee is in addition to the fee in item 36C)
36E	For holding a dog in quarantine at a quarantine station and performing services in relation to the dog	$149.00 a day for each dog
36F	For holding a bitch that bears pups while in quarantine at a quarantine station	In addition to the fee under item 36E—$1 500.00
36G	For holding one or more pups in the litter of a bitch in quarantine at a quarantine station and performing services in relation to the pups	$11.00 a day per litter (if the pups are born in quarantine, this fee is in addition to the fee in item 36F)
36H	For holding a rabbit or a guinea pig in quarantine at a quarantine station and performing services in relation to the rabbit or guinea pig	$5 a day for each animal
36J	For holding a queen bee in quarantine at a quarantine station, and performing services in relation to the queen bee (including entomological testing and the provision of services by a technical officer for a consignment of up to 12 queen bees)—if reproductive management and the nucleus colony are provided by the importer	(a) for the first 2 months in quarantine, other than for the months of June and July: (i) if each queen bee is kept in a separate flight cage, the fee is as follows:

36K	For holding a queen bee in quarantine at a quarantine station, and performing services in relation to the queen bee (including entomological testing and the provision of services by a technical officer for a consignment of up to 12 queen bees)—if reproductive management and the nucleus colony are provided by the Department	(a) for the first 2 months in quarantine, other than for the months of June and July: (i) if each queen bee is kept in a separate flight cage, the fee is as follows:

36L	For holding a live bird in quarantine at a quarantine station and performing services in relation to the bird	For each consignment—$531.00 a day
36M	For holding in quarantine, at a quarantine station, birds’ eggs for hatching and performing services in relation to the eggs	For each consignment—$620.00 a day (including the days after the eggs have hatched)
37	For holding in quarantine, at a quarantine station, an animal that: (a) is not mentioned in items 36 to 36M; and (b) weighs less than 60 kg; not including the provision of feed or veterinary supplies	$16.00 a day for each animal
38	For holding in quarantine, at a quarantine station, an animal that: (a) is not mentioned in items 36 to 36M; and (b) weighs 60 kg or more; not including the provision of feed or veterinary supplies	(a) for each of the first 25 animals in a consignment—$34.00 a day; and (b) for each additional animal in the consignment—$10.00 a day
