STATUTORY RULES.
REGULATIONS UNDER THE QUARANTINE ACT 1908-1924.

Regulations under the

Amendment of Quarantine Regulations 1927.
The Quarantine Regulations 1927 (Statutory Rules 1927, No. 8) are amended—
By omitting regulations numbered 87, 88, 89, 90, 91, 92, 93 and 94 and substituting therefor the following:—
87. The owner of any zoological garden, circus, or theatre may apply to the Director of Quarantine for—
(
a ) the registration of his premises as a zoological garden, circus, or theatre for the quarantine of animals imported for exhibition purposes;(
b ) a licence to introduce wild or undomesticated animals or circus, or performing animals to his registered premises.
The application shall be in the following form:—

.............................................. as a place for the quarantine of animals imported for exhibition purposes, and for a licence to introduce wild or undomesticated animals, or circus or performing animals to such registered premises, and herewith submit the sum of 20 shillings as registration fee, together with a bond of £100 to observe all the Regulations under the Quarantine Act, and all orders of the Chief Quarantine Officer (Animals) with respect to the conditions of quarantine.

Provided that no fee shall be required for registration under these Regulations, of any premises licensed under Statutory Rules of 1927, No. 8, if made within three months of the date of passing of these Regulations.

88.—(1.) The Director of Quarantine may on the recommendation of the Chief Quarantine Officer, register the premises as an “A” class or as a “B” class zoological garden, circus, or theatre and issue a licence to the owner thereof to introduce wild or undomesticated animals or circus or performing animals to the registered premises.
(
a ) Nozoological garden, circus or theatre shall be registered as an “A” class zoological garden, circus or theatre unless the premises are at, or adjacent to, a port of landing for animals, and are under the control of a trust or body corporate.(
b ) A zoological garden, circus or theatre may be registered as a “B” class zoological garden, circus or theatre if the premises are—(i) remote from a port of landing for animals, or
(ii) not under the control of a trust or body corporate.

c ) The licence shall be in the following form:—

............................................ which is registered under the Quarantine Regulations as and, subject to the Quarantine Act and Regulations, permits the introduction of wild or undomesticated animals or circus or performing animals for exhibition purposes.

d ) Registration of any premises shall be effected by the entry in a register, kept for the purpose, by the Director of Quarantine, of the following particulars:—Date of Registration.

(2.) The Director of Quarantine may at any time cancel any licence issued, or registration made, by him.
89. Subject to the Regulations, wild or undomesticated animals for exhibition or performing purposes may be introduced from any country into an “A” class zoological garden, circus or theatre, but they shall not be released from quarantine:
Provided that before being introduced into any circus they shall be detained for six months in a zoological garden or theatre, unless the Minister otherwise directs:
Provided further that the Minister may permit the release from quarantine of any birds.
90. Domesticated animals (other than horses, cattle, sheep, or goats) may be introduced for exhibition purposes from any country into an “A” class zoological garden or theatre or, with the consent of the Director of Quarantine into an “A” class circus, but if they are from a country from which the importation of the same species is prohibited they shall not be released from quarantine.
91. The Minister may, on the recommendation of the Chief Quarantine Officer, permit the introduction of any animal into a scientific institution to be quarantined at such place and under such conditions as may be specified.
92. The Chief Quarantine Officer may permit the transfer of any animal from a registered zoological garden, circus, or theatre to any other registered zoological garden, circus, or theatre, the owner of which holds a valid licence and may specify the conditions under which the transfer may be made, but no permit shall be given for the transfer of animals from any “A” class premises to any “B” class premises without the written consent of the Director of Quarantine.
93. Wild or undomesticated animals and circus or performing animals shall while in quarantine be subject to such conditions and treatment as the Chief Quarantine Officer directs or as are provided in respect of the same class of animal generally. The cost of such treatment and of compliance with any condition shall be borne by the importer.
94. The owner of any zoological garden, circus, or theatre who applies for registration under these Regulations shall enter into a bond of £100 to comply with the Quarantine Regulations and orders of the Chief Quarantine Officer concerning the quarantine of wild or undomesticated animals, or circus, or performing animals and with the following conditions, viz.:—
(
a ) that in the event of the sickness or death of any animal in a registered zoological garden, circus, or theatre, the owner shall give notice forthwith to the Chief Quarantine Officer;(
b ) that wild or undomesticated animals shall at all times be kept securely confined in cages or enclosures approved by the Chief Quarantine Officer and if removed therefrom for any performance shall be returned to such confinement immediately after the performance is completed, and that all other animals on the premises shall be controlled in such manner as the Chief Quarantine Officer directs;(
c ) that in the case of a registered circus the owner shall furnish a statement to the Director of Quarantine on the first day of July in each year specifying the number of animals of each species held or utilized by him for the purpose of the circus.
94a. The owner of any animal for exhibition or performing purposes introduced into any registered circus or theatre of which he is not the owner shall enter into a bond of £50 to comply with the Quarantine Regulations and orders of the Chief Quarantine Officer and to pay the cost of examination, conveyance, detention, maintenance, disinfection or treatment of the said animal until it dies or is destroyed or released from quarantine.
The word “owner” in relation to any zoological garden, circus or theatre includes director, lessee, agent, or person responsible for the premises to which the expression refers.
