REGULATIONS UNDER THE
QUARANTINE ACT 1908-1950.*
THE
GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
under the Quarantine Act 1908-1950.

Amendments of the Quarantine
(Plants) Regulations.
1. Regulations 6
and 7 of the Quarantine (Plants) Regulations are repealed and the following
regulations inserted in their stead :—
Fees for Inspection and examination.
“ 6.—(1.) Where, by virtue of the
Act or these Regulations, a quarantine officer inspects or examines plants or
goods, the importer of the plants or goods, or, if the plants or goods are not
imported plants or goods, the owner of the plants or goods, shall pay to the
Commonwealth in respect of the inspection or examination of each lot of those
plants or goods which the quarantine officer inspects or examines separately a
fee determined in accordance with the Second Schedule.
“ (2.) Notwithstanding the
last preceding sub-regulation, the amount of a fee payable in respect of an
inspection or examination of plants or goods shall be not less than One
shilling.
“ (3.) Where, under the
Second Schedule, a fee is specified in relation to the weight of plants or
goods, the weight of containers and packing shall not be taken into account in
determining the amount of the fee payable.
“ (4.) Where a fee is payable
under this regulation in respect of plants or goods in quarantine, the plants
or goods shall not be released from quarantine until the fee is paid.
“ (5.) This regulation does
not apply to the inspection or examination of a small quantity of plants or
goods carried as part of the personal luggage (other than luggage carried in
the hold of a ship) of a passenger on, or a member of the crow of, a ship or
aircraft.

Fee for fumigation.
“ 7.—(1.) Where the fumigation of
plants or goods is carried out by a quarantine officer, the importer of the
plants or goods, or, if the plants or goods are
not imported plants or goods the owner of the
plants or goods, shall pay to the Commonwealth in respect of the fumigation a
fee at the rate of Threepence for each cubic foot of space occupied by the
plants or goods.
“ (2.) Notwithstanding the
provisions of the last preceding sub-regulation, the amount of a fee payable in
respect of the fumigation of plants or goods shall be not less than One
shilling.
“ (3.) Where a fee is payable
under this regulation in respect of plants or goods in quarantine, the plants
or goods shall not be released from quarantine until the fee is paid.
Fees for supervision.
“ 7a.—(1.) Where the
services of an officer arc made available for the supervision of the fumigation
or other treatment of plants or goods, the importer of the plants or goods, or,
if the plants or goods are not imported plants or goods, the owner of the plants or
goods, shall pay to the Commonwealth for those services—
(a)a fee calculated at the rate of Five
shillings for each half of an hour, or part of half of an hour, included in the
period during which the quarantine officer is engaged in performing those
services ; or
(b)a fee equal to the amount, of the expense
to the Commonwealth of those services,
whichever is the
greater.
“ (2.) Where a fee is payable
under this regulation in respect of plants or goods in quarantine, the plants
or goods shall not be released from quarantine until the fee is paid.
Charge for labour supplied.
“ 7b. Where, at the request of the owner of plants or goods or
of any other person, a quarantine officer makes labour available for the
purpose of handling the plants or goods in connexion with their inspection,
examination, fumigation or other treatment, the owner or other person shall pay
to the Commonwealth in respect of each person engaged in performing that labour
a fee calculated at the rate of Seven shillings and sixpence for each hour, or
part of an hour, included in the period during which the person is engaged in
the handling of the plants or goods.
Fee for inspections, &c., out of ordinary hours.
“ 7c.—(1.) Where a service in respect of which a fee is
payable under these Regulations is, at the request of the person by whom the
fee is payable, performed before or after official hours or on a Sunday or
holiday, the amount of the fee which, but for this regulation, would be payable
in respect of that service shall be increased by one-half.
“ (2.) In this regulation, ‘ holiday
’ means a day observed as a holiday in the Public Service of the Commonwealth
by virtue of section 76 of the Public Service Act 1922-1953.”.

2. Regulation 20 of
the Quarantine (Plants) Regulations is repealed.

3. The Second
