REGULATIONS UNDER THE QUARANTINE ACT 1908-1950.*

advice of the Federal Executive Council, hereby make the following Regulations
under the

Amendments of the Quarantine (Animals) Regulations.
“15. Cattle from New Zealand shall not be landed unless the following documents have been delivered to the Chief Quarantine Officer in respect of each animal:—
(
a )a declaration by the owner stating—(i) that the animal has been in New Zealand during the whole of the period of sixty days next preceding the date of shipment;
(ii) that the animal—
(A) has been subjected to a blood test for brucellosis during the period of fourteen days next preceding the date of shipment; or
(B) being a female animal, was, when it was between four months old and eight months old, vaccinated by a veterinary surgeon named in the declaration with strain 19 brucellosis vaccine on a date specified in the declaration, being a date during the period of three years next preceding the date of shipment; and

(iii) if the animal was imported into New Zealand, the date of the importation and the country from which it was imported;
(
b )where the declaration by the owner stat.es that the animal has been subjected to a blood test for brucellosis, a certificate by an approved veterinary surgeon certifying—(i) that, during the period of thirty days next preceding the date of shipment, he subjected the animal to an intradermal mammalian tuberculin test and to an intradermal avian tuberculin test and obtained a negative result in each test; and
(ii) that a blood sample collected by him from the animal during the period of fourteen days next preceding the date of shipment and submitted to the agglutination test for brucellosis at a laboratory proved negative;
(
c ) where the declaration by the owner states that the animal, being a female animal, was vaccinated with strain 19 brucellosis vaccine—(i) a certificate by an approved veterinary surgeon certifying that, during the period of thirty days next preceding the date of shipment, he subjected the animal to an intradermal mammalian tuberculin test and to an intradermal avian tuberculin test and obtained a negative result in each test; and
(ii) a certificate by the veterinary surgeon specified by the owner in the declaration certifying that, on the date specified by the owner in the declaration, the veterinary surgeon vaccinated the animal with strain 19 brucellosis vaccine and that on that date the animal was between four months old and eight months old; and
(
d )a certificate by a Government veterinary surgeon certifying that the animal is free from disease and that, after due inquiry, he is satisfied—(i) that, to the best of his knowledge and belief, Johne’s disease has not been found at any time in any animal upon promises or land where the animal has been kept or pastured; and
(ii) as to the truth of the declaration referred to in paragraph (
a ) of this regulation.”.
(
a )by omitting the words “,Eire, or the Channel Islands” (wherever occurring) and inserting in their stead the words “or the Republic of Ireland”; (
b )by omitting sub-paragraphs (iii) and (iv) of paragraph (a )and inserting in their stead the following sub-paragraphs:—“(iii) that to the best of his knowledge and belief Johne’s disease has not been found at any time in any animal upon premises or land where the animal has been kept or pastured;
(iv) that the animal has been subjected to an intradermal mammalian tuberculin test and to an intradermal avian tuberculin test during the period of two months next preceding the date of shipment; and
(v) that the animal.—
(A) has been subjected to a blood test for brucellosis during the period of fourteen days next preceding, in the case of an animal shipped from. England, the date of entering the quarantine station, or, in any other case, the date of shipment; or
(B) being a female animal, was, when it was between four months old and eight months old, vaccinated by a veterinary surgeon named in the declaration with strain 19 brucellosis vaccine on a date specified in the declaration, being a date during the period of three years next preceding the date of shipment;”;
(c) by omitting paragraph (
b )and inserting in its stead the following paragraphs:—“(
b )where the declaration by the owner states that the animal has been subjected to a blood test for brucellosis, a certificate by an approved veterinary surgeon certifying—(i) that, during the period of two months next preceding the date of shipment, he subjected the animal to an intradermal mammalian tuberculin test and to an intradermal avian tuberculin test and obtained a negative result in each test; and
(ii) that a blood sample collected by him from the animal during the period of fourteen days next preceding, in the case of an animal shipped from. England, the date of the animal entering the quarantine station, or, in any other case, the date of shipment, and submitted to the agglutination test for brucellosis at a laboratory proved negative;
(
ba )where the declaration by the owner states that the animal, being a female animal, was vaccinated with strain. 19 brucellosis vaccine—(i) a certificate by an approved veterinary surgeon certifying that, during the period of two months next preceding the date of shipment, he subjected the animal to an intradermal mammalian tuberculin test and to an intradermal avian tuberculin test and obtained a negative result in each test; and
(ii) a certificate by the veterinary surgeon specified by the owner in the declaration certifying that, on the date specified by the owner in the declaration, the veterinary surgeon vaccinated the animal with strain 19 brucellosis vaccine and that on that date the animal was between four months old and eight months old;”;
(
d )by omitting from sub-paragraph (iv) of paragraph (c) the word “Eire” and inserting in its stead the words “the Republic of Ireland”;(
e )by omitting from that paragraph the word “and” (last occurring)”;(
f ) by omitting sub-paragraph (v) of paragraph (c) and inserting in its stead the following sub-paragraphs:—“(v) that, to the best of his knowledge and belief, Johne’s disease has not been found at any time in any animal upon premises or land where the animal has been kept or pastured; and
(vi) as to the truth of the declaration referred to in paragraph (
a )of this regulation;”; and(
g ) by omitting from paragraph (d )the word “Eire” and inserting in its stead the words “the Republic of Ireland”.
(
a ) by omitting sub-paragraph (iii) of paragraph (a )and inserting in its stead the following sub-paragraph:—“(iii) in the case of an animal from the United States of America, that the animal has been submitted to tests by blood inoculation for the presence of anaplasmosis and piroplasmosis and for the presence of bluetongue;” and
(
b )by inserting in sub-paragraph (ii) of paragraph (c ), after the word “piroplasmosis”, the words “and the presence of bluetongue
“18. Goats from New Zealand shall not be landed unless there has been delivered to the Chief Quarantine Officer in respect of each animal a certificate by a Government veterinary surgeon certifying—
(
a )that the animal is free from disease; and(
b )that a blood sample collected from the animal during the period of fourteen days next preceding the date of shipment and submitted to the agglutination test for brucellosis at a laboratory proved negative.
“18a. Sheep from New Zealand shall not be landed unless the following documents have been delivered to the Chief Quarantine Officer in respect of each animal:—
(a) a declaration by the owner stating—
(i) that the animal has been in New Zealand during the whole of the period of six months next preceding the date of shipment;
(ii) that, to the best of his knowledge and belief, the animal has not been kept or pastured upon promises or land where scrapie has been found in sheep at any time during the period of five years next preceding the date of shipment; and
(iii) that, to the best of his knowledge and belief, the animal has not, at, any time during the period of two years next preceding the date of shipment, been upon the same premises or land as sheep from other premises or land where scrapie has been found in sheep at any time during the period of five years next preceding the date of shipment;
(
b )a certificate by a Government veterinary surgeon certifying that, after due inquiry, he is satisfied as to the truth of the declaration referred to in the last preceding paragraph; and(c) a certificate of general health by a. Government veterinary surgeon at the port of shipment.”.
(
a ) by omitting the words “Sheep and goats from Great Britain, Northern Ireland, Eire, or the Channel Islands” and inserting in their stead the words “Goats from Great Britain, Northern Ireland or the Republic of Ireland”;(
b )by omitting paragraph (a) and inserting in its stead the following paragraphs:—“(
a ) a declaration by the owner stating—(i) that the animal has not been in a country other than Great Britain, Northern Ireland or the Republic of Ireland during the period of six months next preceding the date of shipment and that the animal has been free from disease during that period;
(ii) that the animal has not been in contact with an animal suffering from disease during that period;
(iii) that the animal has been subjected to a blood test for brucellosis during the period of fourteen days next preceding, in the case of an animal shipped from England, the date of entering the quarantine station, or, in any other case, the date of shipment; and
(iv) that the animal has been dipped by thorough immersion in an effective scab-destroying preparation during the period of fourteen days next preceding the date of shipment, and specifying the exact nature of the dipping operation, or, if the animal has not been so dipped, that it is to pass through a quarantine station under the control of the Ministry of Agriculture and Fisheries in England;
(
aa )a certificate by an approved veterinary surgeon certifying that a blood sample collected by him from the animal during the period of fourteen days next preceding, in the case of an animal shipped from England, the date of the animal entering the quarantine station, or, in any other case, the date of shipment, and submitted to the agglutination test for brucellosis at a laboratory proved negative;(
c ) by omitting from paragraph (b )the word. “Eire” and inserting in its stead the words “the Republic of Ireland”; and(
d )by omitting from paragraph (c )the word “Eire” and inserting in its stead the words “the Republic of Ireland”.
“21. Swine from New Zealand shall not be landed unless the following documents have been delivered to the Chief Quarantine Officer in respect of each animal:—
(
a ) a declaration by the owner stating—(i) that the animal has been in New Zealand during the whole of the period of six months next preceding the date of shipment;
(ii) that, during that period, the animal has been free from disease and has not been in contact with any animal suffering from disease;
(iii) that the animal has been subjected to a blood test for
Brucellosis suis during the period of fourteen days next preceding the date of shipment; and(iv) if the animal was imported into New Zealand, the date of the importation and the country from which it was imported;
(
b )a certificate by an approved veterinary surgeon certifying that a blood sample collected by him from the animal during the period of fourteen days next preceding the date of shipment and submitted to the agglutination test forBrucellosis suis at a laboratory proved negative; and(c) a certificate by a Government veterinary surgeon certifying—
(i) that the animal is free from disease; and
(ii) that, after due inquiry, he is satisfied as to the truth of the declaration referred to in paragraph (
a ) of this regulation.”.
“22. Swine from Northern Ireland or the Republic of Ireland shall not be landed unless the following documents have been delivered to the Chief Quarantine Officer in respect of each animal:—
(a) a declaration by the owner stating—
(i) that the animal has not been in a country other than Northern Ireland or the Republic of Ireland during the period of six months next preceding the date of shipment from Northern Ireland or the Republic of Ireland and that the animal has been free from disease during that period;
(ii) that the animal has not been in contact with an animal suffering from disease during that period; and
(iii) that the animal has been subjected to a blood test for
Brucellosis suis during the period of fourteen days next preceding the date of shipment;(
b )a certificate by an approved veterinary surgeon certifying that a blood sample collected by him from the animal during the period of fourteen days next preceding the date of shipment and submitted to the agglutination test forBrucellosis suis at a laboratory proved negative;(
c ) a certificate by a responsible Government veterinary surgeon certifying that, after due inquiry, he is satisfied—(i) as to the truth of the declaration referred to in paragraph (
a ) of this regulation; and(ii) that there has not been a case of foot and mouth disease in Northern Ireland or the Republic of Ireland during the period of three months next preceding the date of shipment;
(
d )in the case of an animal shipped on a vessel calling at a port in England, a certificate by an approved veterinary surgeon certifying that, during the stay of the vessel at that port, the animal has been kept isolated under the supervision of an officer of the Ministry of Agriculture and Fisheries in England;(e) in the case of an animal shipped to England for shipment to Australia, a certificate by a responsible Government veterinary surgeon in England certifying—
(i) that the animal was, on arrival in England, taken direct to a quarantine station under the control of the Ministry of Agriculture and Fisheries in England;
(ii) that the animal remained in the quarantine station for a period of fourteen days and, if not shipped at the end of that period, that it remained in the quarantine station until shipped; and
(iii) that, after due inquiry, he is satisfied that any fodder and bedding (being bedding derived from a cereal) which have been obtained in Great Britain have been obtained from districts which have been free from foot and mouth disease during the whole of the period of three months next preceding the date of shipment and that the fodder and bedding have not been exposed to contamination during that period; and
(
f ) a certificate by an approved veterinary surgeon at the port of shipment in Northern Ireland or the Republic of Ireland, as the case may be, and, if the animal was then taken to England for shipment, a certificate by an approved veterinary surgeon at the port of shipment in England, as to the health of the animal.”.
(
a )by omitting the word “Eire” and inserting in its stead the words “the Republic of Ireland”;(
b )by omitting from paragraph (a ) the word “and” (last occurring); and(c) by inserting, after that paragraph, the following paragraph:—
“(
aa )in the case of a dog from Great Britain, Northern Ireland or the Republic of Ireland, a certificate by an approved veterinary surgeon certifying that, during the period of fourteen days next preceding the date of shipment, he subjected the dog to a blood test for Leptospirosis and obtained a negative result; and”.
(2.) This regulation shall come into operation on the first day of May, 1955.
“36.—(1.) Where a quarantine officer permits an animal to leave aship or quarantine station under quarantine surveillance, the permit shall be in accordance with Form B.
“(2.) The owner or person in charge of an animal under quarantine surveillance—
(a) shall submit the animal to inspection and treatment by a quarantine officer when required so to do by the Chief Quarantine Officer;
(
b )shall immediately report any disease or suspected disease in the animal or the death of the animal to the Chief Quarantine Officer;(
c )shall keep the animal under such conditions as are notified to him in writing by the Chief Quarantine Officer;(
d )shall, if the animal is ordered into quarantine, immediately remove the animal to a quarantine station or such other place as is specified by the Chief Quarantine Officer; and(e) shall immediately carry out, or cause to be carried out, any test on the animal which the Chief Quarantine Officer requires him to carry out.
“(3.) The owner of an animal under quarantine surveillance shall not sell the animal except with the consent of the Chief Quarantine Officer and in accordance with such conditions as the Chief Quarantine Officer determines.”.
“38.—(1.) Cattle in quarantine or under quarantine surveillance may be tested for tuberculosis, Johne’s disease and brucellosis.
“(2.) Goats in quarantine or under quarantine surveillance may be tested for brucellosis.
“(3.) Dogs in quarantine or under quarantine surveillance may be tested for Leptospirosis.
“(4.) The tests referred to in the last three preceding sub-regulations shall he conducted by a quarantine officer who is a veterinary surgeon.
“(5.) Sheep and goats in quarantine or under quarantine surveillance shall he shorn and dipped in a medicament approved by the Chief Quarantine Officer.
“(6.) All wool and hair removed from a sheep or goat which is in quarantine or under quarantine surveillance shall be thoroughly immersed in the medicament or, if the Chief Quarantine Officer so directs, for five minutes in boiling water.
“(7.) Where the Chief Quarantine Officer is of opinion that any wool or hair which has been removed from an animal in quarantine or under quarantine surveillance should not be released because of the presence of disease, he shall cause the wool or hair to be destroyed by burning.
“(8.) An animal which is in quarantine or under quarantine surveillance shall be dealt with in such manner, and shall be subjected to such tests and treatment, as the Chief Quarantine Officer directs.”.
“(
aa )not, in the case of an A class registered zoological garden, remove from, it, or permit to be removed from it, litter used in connexion with, or the manure of, an animal;”.
“66. Eggs for hatching purposes from New Zealand shall not be landed unless the following documents have been delivered to the Chief Quarantine Officer—
(
a )a declaration by the owner stating—(i) that the eggs were produced at a farm upon which tests for the disease bacillary white diarrhoea have been carried out at regular intervals; and
(ii) that birds showing a positive reaction to any of those tests have been immediately removed from the farm; and
(
b )a certificate by an approved veterinary surgeon certifying that, after due inquiry, he has no reason to doubt the truth of the declaration referred to in the last preceding paragraph.”.
“(a ) the carcases of birds commonly known as ‘game’ imported from and having their origin in New Zealand;”.
“92. The litter used in connexion with, and the manure of, an animal which is in quarantine or in an A class registered zoological garden shall, if the Chief Quarantine Officer so requires, be destroyed by burning, or saturated with a disinfectant solution.”.
