REGULATIONS UNDER THE QUARANTINE ACT 1908-1924.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Quarantine Act 1908-1924, to come into operation on the first day of July, 1934.

1. These Regulations may be cited as the Quarantine (Air Navigation) Regulations 1934, and shall be read in conjunction with the Quarantine Regulations 1927.

2. In these Regulations—

“Master” in relation to a vessel engaged in navigation by air means the person in charge or command of the vessel.

“Authorized aerodrome” means a customs or other aerodrome, specially designated by the competent authority of the country in which it is situated, on which aircraft may make their first landing on entering a territory or which they may make their place of departure on leaving a territory.

3.The Master of every oversea vessel engaged in navigation by air shall send by telegraphic cable or by wireless telegraph a message stating—

(1) the registered marking of the vessel and the expected date and time of arrival in Australia;

(2) the name of the last oversea landing place called at.

Such message must be despatched at such time and place that it will arrive at the first landing place in Australia not less than 3 hours before the expected time of arrival of the vessel.

In the case of a vessel intended to land at Darwin the message shall be addressed to the Administrator, Darwin.

In the case of a vessel intended to land at a landing place other than Darwin the message shall be addressed to the Postmaster at the intended landing place.

4. The Master of every oversea vessel engaged in navigation by air shall on arrival at the first landing place in Australia produce to the Quarantine Officer a certificate from each authorized aerodrome called at by his vessel stating that the crew and passengers of the vessel did not show symptoms of any infectious disease at the time of departure.

This certificate shall be signed by an accredited medical officer of the Health Department of the country concerned.

The form of the certificate shall be as follows:—

5.The Master of every oversea vessel engaged in navigation by air which has any enclosed space or cabin for the accommodation of passengers or of mails or other freight shall on arrival at the first landing place in Australia produce a certificate to the Quarantine Officer from the last place called at by his vessel before reaching Australia, stating that the vessel has been treated effectively at that place for the destruction of mosquitoes immediately before departure.

The certificate shall be signed by a responsible officer of the Health Department of the country concerned.

The method of treatment shall be the spraying or fumigation of all parts of the interior of the aeroplane with a vapour effective for the destruction of mosquitoes.

The certificate shall be given in the following form:—

I, an officer of the Department of Health at    hereby certify that the vessel  of which  is Master was effectively treated by* for the destruction of mosquitoes immediately before departure from this aerodrome.

6.The Master of every vessel engaged in navigation by air shall when required by a Quarantine Officer submit the vessel to fumigation, spraying or other treatment.

7.—(1.) Every member of the crew and every passenger on every oversea vessel engaged in navigation by air shall on arrival at the first landing place in Australia produce to the Quarantine Officer a certificate attesting that he has been successfully vaccinated against small-pox within three years prior to embarkation on the vessel or that he has given proof of adequate immunity.

This certificate shall be signed by a responsible officer of the Department of Health of the country in which the certificate is given and shall contain an intimation of the office held by the person signing the certificate.

The certificate shall be given in the following form:—

I,   an officer of the Department of Health at   certify that  (a)was successfully vaccinated against small-pox on the  day of   19 ;

(b) is adequately immunized against small-pox.

For the purposes of this regulation a person shall be considered adequately immunized against small-pox if he can produce proof of a previous attack of small-pox or if he has been vaccinated within less than three years and has, to the personal knowledge of the certifying medical officer, shown signs of early reaction attesting an adequate immunity.

(2.) Every person who fails to produce a certificate in accordance with the requirements of this regulation shall submit to vaccination and shall be vaccinated on arrival at the first landing place in Australia.

8.The Master of every oversea vessel engaged in navigation by air, shall, on arrival at the first landing place, and at each landing place subsequently called at for which pratique is not held, cause his vessel to come to a stop at a spot on the prescribed landing place marked by a signal and shall remain there until pratique has been granted. This signal shall be—

From sunrise to sunset the flag known as flag Q being a yellow flag of six breadths of bunting.

From sunset to sunrise, three lights (two red and one white) of such a character as to be visible on a clear night by any vessel engaged in navigation by air from a distance of two miles, and placed at distances of 6 feet apart in the form of an equilateral triangle.

9. An unauthorized person shall not approach within a distance of 30 yards of the spot at which this signal is displayed.

10.The Master of every vessel engaged in navigation by air shall, on arrival at the first landing place in Australia furnish to the Quarantine Officer a complete list of all passengers on board and the full address in Australia of every passenger.

11. The Master of every oversea vessel engaged in navigation by air, shall, on arrival at the final landing place in Australia make a declaration to the Quarantine Officer giving particulars of such cases of sickness as have occurred on the vessel during the voyage. The declaration shall be in the following form:—

12. Every person arriving in Australia by a vessel engaged in navigation by air shall, on arrival at the first landing place in Australia give to the Quarantine Officer an undertaking in writing to report any sickness occurring within eighteen days of his departure from the last oversea port of call to the Chief Quarantine Officer of the State in which he then is. The undertaking shall be in the following form:—

“I, hereby undertake to report immediately to the Chief Quarantine Officer of the State in which I am residing any sickness from which I may be suffering at any time up to and including the day of , 19 .

13.The Minister may exempt the Master of any vessel engaged in navigation by air from the requirements of any of these Regulations if he is satisfied that the particular circumstances relating to the vessel are such that risk of introduction of infection has been adequately safeguarded.

Penalty for Breach of Regulations.

14. Except in these cases where a penalty is specially provided in the Act for any offence against the Act or breach of the Regulations made thereunder, the penalty for a breach of any of the Quarantine (Air Navigation) Regulations shall be a sum not exceeding Fifty pounds.
