a m e n d the said reci ted Ac t in m a n n e r hereinaf ter ment ioned Be it therefore enacted by H i s Excel lency t h e Governor of New South Wales w i th t h e advice of t h e Legis la t ive Counci l thereof T h a t i t shal l be lawful for t h e H e a l t h Officers duly appoin ted for t h e H a r b o u r s of P o r t J ackson a n d P o r t Ph i l l ip respectively to order any ship or vessel a r r iv ing in t h e said ha rbours from p a r t s beyond seas in to Qua ran t i ne provided the re be a t t he t i m e or shal l have been d u r i n g t h e voyage any infectious or contagious disease on board such ship or vessel or provided such ship or vessel shal l have touched a t any por t or place du r ing t h e voyage

W H E R E A S H i s la te Majesty K i n g W i l l i a m the F o u r t h in t i tu led " An Act
an Act was passed in t he t h i r d year of t he re ign of
" for subjecting Vessels coming to New South Wales from certain places
" to the performance of Quarantine" and whereas i t is expedient to

voyage where any such infectious or con tag ious disease shall have pre­ vailed or shal l have communica ted wi th any o ther ship or vessel on board which any such disease m a y have exis ted in consequence of which danger may reasonably be apprehended to t he publ ic hea l th from t h e immed ia t e admission of any such ship or vessel to en t ry Provided t h a t every such case be immedia te ly repor ted by such H e a l t h Officer to H i s Excel lency t h e Governor a t Sydney or H i s H o n o r t h e Super in t enden t a t Mel ­

b o u r n e as t he case m a y be in order t h a t fu r ther measures m a y be
t a k e n according to law for t h e con t inuance of such ship or vessel in
Q u a r a n t i n e or t h e release thereof as m a y be j udged expedient and

every such ship or vessel so placed in Q u a r a n t i n e wi th t he con ten ts thereof and every person on board w h e t h e r any such person shal l be long to or have come as a passenger by such ship or vessel or shall have gone on board t h e same after t h e ar r iva l thereof in ei ther of the said po r t s shall be subject to t h e same laws ru les a n d penal t ies in all respects as are in force wi th respect t o ships goods or persons placed

in Q u a r a n t i n e u n d e r t h e provis ions of t h e said reci ted Act .

2. A n d whereas it is expedient to vest in H i s H o n o r t he Super­

in t enden t of P o r t Phi l l ip or t h e Chief Officer resident in and admin­
is te r ing t h e Gove rnmen t of t h e said distr ict such a n d t h e l ike powers
in respect t o m a t t e r s of Q u a r a n t i n e as are by t h e said reci ted A c t
vested in H i s Excel lency t h e Governor of N e w Sou th W a l e s w i t h t he
advice of t h e Execu t ive Counci l thereof Be it therefore enacted Tha t
w i th in t h e l imits of t h e Dis t r ic t of P o r t Ph i l l ip the same powers and

au tho r i t y in respect t o t h e performance of Q u a r a n t i n e by any ships or vessels persons goods wares merchand i se packets packages baggage wea r ing appare l books le t te rs or any other ar t ic le or t h i n g whatsoever or in respect t o t h e p reven t ion of infectious or contagious disease prevai l ing on shore in any p a r t of t h e said distr ict shall be vested in

H i s H o n o r the Super in tenden t of P o r t Phi l l ip or t h e Chief Officer

resident in and admin i s t e r ing t h e Gove rnmen t of t h e said distr ict as fully and effectually and to all i n t en t s and purposes as are now vested in H i s Excel lency t h e Governor of N e w South Wales wi th the advice

of t h e Execu t ive Counci l thereof u n d e r t h e provisions of t h e said
