CaseChat Overview and Summary
The primary legal issue before the Commission was whether the proposed enterprise agreement provided for the proper and timely payment of minimum rates of pay, allowances, loadings and penalty rates as prescribed by the relevant awards and whether it complied with the good faith bargaining requirements. The Commission also had to consider the balance of benefits and detriments in the agreement and whether it was in the best interests of the employees.
In its decision, the Fair Work Commission found that the proposed agreement met the necessary criteria for approval. The Commission noted that the agreement provided for the payment of minimum rates of pay and included appropriate allowances, loadings and penalty rates. The Commission was satisfied that the agreement was the product of good faith bargaining and that the balance of benefits and detriments was fair and reasonable. Consequently, the Commission approved the Goodman Fielder Baking (Victoria) Agreement 2020-2023.
The Fair Work Commission approved the Goodman Fielder Baking (Victoria) Agreement 2020-2023, effective from the date of the decision. The terms of the agreement will now apply to the relevant employees and employers as specified in the approved agreement.
