CaseChat Overview and Summary

Quality Bakers Australia Pty Limited, trading as Goodman Fielder, sought approval for the Goodman Fielder Baking (Darwin) Enterprise Agreement 2013-2016. The applicant argued that the proposed agreement was fair and reasonable for the employees covered by the agreement. The Fair Work Commission heard the application and needed to determine whether the agreement met the statutory requirements under the Fair Work Act 2009.

The primary legal issue before the Commission was whether the enterprise agreement complied with the requirements of the Fair Work Act, including provisions regarding the agreement's coverage, the process by which it was made, and its compliance with the "better off overall test." The Commission also had to consider whether the agreement provided for fair and reasonable terms and conditions of employment.

The Commission found that the agreement had been made in good faith and covered a broad range of employees. It noted that the agreement had been negotiated between the parties and contained provisions that addressed key aspects of employment, including wages, hours of work, and conditions of employment. The Commission was satisfied that the agreement provided for fair and reasonable terms and conditions of employment and met the "better off overall test." The Commission also found that the process by which the agreement was made was fair and reasonable.

The Commission approved the Goodman Fielder Baking (Darwin) Enterprise Agreement 2013-2016, finding it to be fair and reasonable and compliant with the requirements of the Fair Work Act. The agreement was approved on the terms and conditions set out in the decision of the Fair Work Commission.
