JUDGMENT

HIS HONOUR:  I give judgment for the plaintiff on the claim in

the amount of 1,266,714.35.

I dismiss the counterclaim.

I order that the defendant pay the plaintiff's costs of and

incidental to the action on the indemnity basis to be assessed

pursuant to UCPR 704 (iii)(b) if not agreed.

I order that the defendant pay the plaintiff's costs of and

incidental to the counterclaim on the standard basis to be

assessed if not agreed.

I order interest on any unpaid balance of the judgment amount

in terms of section 48 of the Supreme Court Act.

I stay execution of the judgment for a period of 14 days from

the date of service of the judgment.
