to amend the Public Works Act, 1912, as

amended by subsequent A cts; and for

purposes connected therewith. [Assented

“O E it enacted by the King’s Most Excellent Majesty, i J by and ■with the advice and consent of the Legis­

lative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows

Short title.

1. (1) This Act may be cited as the “ Public Works

(Sale of Wickham Lands) Act, 1940.”

This Act shall be read and construed with the

Public Works Act, 1912, as amended by subsequent Acts.

2 . (1) The Minister may sell by pubhe auction, public

The purchase money arising from such sale shall be

applied in such manner ag the Governor may direct.

(2) Upon payment or tender to the Minister of the purchase money in respect of such sale the Minister shall convey the lands, for and on behalf of His Majesty, to the purchasers thereof by deed duly registered.

A deed so executed and registered shall be efiectual to vest the lands comprised therein in the said purchaser for the estate so purchased hy him.

(3) A receipt under the hand and seal of the Minister shall be a sufficient discharge to the purchaser of such lands for the purchase money in the receipt expressed to be received.

(4) This section shall not be construed so as to affect in any way any power of leasing which, under subsection three of section ninety-eight of the Public Works Act, 1912, aŝ amended by subsequent Acts, is exercisable in respect of the lands described in the Schedule to this Act.

SCHEDULE.

All that piece or parcel of land situate in the City of Greater Newcastle, parish of Newcastle, county of Northumherland and State of New South Wales, being part of the land resumed and appropriated for the construction of the Carrington Tramway by noti­ fication in Gazette of 29th May, 1912, and part of the land appropriated for the construction of portion of the wharf frontage known as Wickham Wharf, in the Port of Newcastle, by notification in Gazette of 15th October, 1920:—

Commencing on the north-eastern side of Hannell Street at a point bearing 148 degrees 18 minutes and distant 26 feet from the inter­ section of that side of that street with the south-eastern boundary of an area of 1 acre 26f perches of land dedicated as a public highway by notification in Gazette of 31st March, 1933; and bounded thence on the north-west by lines successively hearing 14 degrees 16 minutes 45 seconds 16 feet 8 inches and 60 degrees 15 minutes 30 seconds 93 feet 9 inches; on the north by a line bearing 95 degrees 37 minutes 30 seconds 19 feet 6 | inches; on the north-east by a line and part of a south-western boundary of the said 1 acre 26| perches of land dedicated as a public highway, in all bearing 130 degrees 59 minutes 30 seconds 443 feet 8J inches; on the south-east by a line bearing 220 degrees 59 minutes 20 seconds 201 feet 3 | inches to the north­ eastern side of Hannell Street aforesaid; and on the south-west by that side of that street, being lines successively bearing 318 degrees 3 minutes 30 seconds 224 feet 4J inches, 296 degrees 56 minutes 40 feet 7 | inches and 328 degrees 18 minutes 231 feet 6i inches to the point of commencement, and having an area of 1 acre 3 roods 16J perches or thereabouts.
