1 . (1) This Act may be cited as the “ Public Works siiorttitis.

(Poi't Kembla Electricity) Amendment Act, 1934.”

(2) Tbe Public Works (Port Kembla Electricity)

Act, 1929, as amended by this Act, may be cited as the

Public "Works (Port Kembla Electricity) Act, 1929-1934.

2. The Public AVorks (Port Kembla Electricity) Act, Amendment

1929, is amended by inserting next after section eight 192V

construct, establish, or extend an electricity generating station; or

(b) consti’uct a main transmission lino; or

(c)

extend a main transmission line Avhetlier the main transmission line proposed to be ex­ tended is within either or both of the said counties or is Avholly or partly outside the said counties.

(2) Where any such construction, establish­ ment or extension as is referred to in subsection one of this section has been commenced within the County of Camden or the County of St. Vincent after the thirtieth day of June, one thousand nine hundred and thirty-four, and before the commencement of this Act no person shall, except with the consent of the Governor and in accordance with any conditions or stipulations which may be specified in such con­ sent, continue or complete such construction, estab­ lishment or extension.

Any person deprived by this section of the benefit of any agreement lawfully entered into prior to the twelfth day of December, one thousand nine hundred and thirty-four, may recover from the Crown any moneys actually expended by him in respect of the carrying out during the period commencing on the first day of July, one thousand nine hundred and thirty-four, and ending on the twelfth day of Decem­ ber, one thousand nine hundred and thirty-four, of any such construction, establishment or extension.

(3) The consent of the Governor under this section may be given subject to such conditions and stipulations as may be specified in the consent.

(4) Any person who contravenes any pro­ vision of subsection one or subsection Dvo of this section shall be liable to a penalty not exceeding five hundred pounds.

(5) Any person who uses for or in connection Avith the generating or supply of electricity any elec­ tricity generating station or main transmission lino constructed, established, extended, continued or completed in contravention of this section shall be liable to a penalty not exceeding fifty pounds for each

(6) Subsections one and two of this section shall not appl}" to or in respect of any private elec­ tricity generating station or private transmission line.

(7) Nothing in this section shall abridge or in any way prejudice or affect any of the powers conferred bj' this Act upon the Minister.
