it is provided that two equal third parts of the gross proceeds

of the sale of the waste lands of the Crown shall be appropriated as and for and shall constitute a fund to be called The Public Worke Fund," and the remaining one-third part of the said gross proceeds shall be appropriated as and for and shall constitute a separate fund, to be called a The Immigration Fund ;" and it is also further provided that no money shall be at any time expended from either of the said fuada, except in respect or on account of the public debt of the said Province, without the sanction of an Act of the Parliament thereof expressly directing or allowing such expenditure: And whereas in pursuance of the several Acts more particularly specified in the Schedule hereto, the Treaeurer has from time to time paid and ex- pended out of the aaid The Public Works Fund" certain sums of money for roads, bridges, railways, and other public works con- nected with the development of the resources of the said Province, and communication between different parts of the same, and has also paid and expended out of the said The Immignrticjn Fund" certain other sums of money towards defraying the expensesof the

into the Province of South Australia: And whereas doubts have arisen as to the validity of such payments, by reason of the said before-mentioned Acts not having expressly directed or allowed such expenditure out of the said respective funds as aforesaid, and it is expedient to remove such daubts: And whereas it is also expedient to direct and allow a further expenditure out of the said The Immigration Fund " as hereinafter mentioned--Be it therefore

from the United Kingdom of Great Britain and Ireland to the said

Province of immigrants, under the provisions of the Act No. 4 of

1857, intituled An Act to authorize the appointment of an Emigra-

tion Agent, and to encourage and regulate Immigration into the

Province of South Australia," such sums of money being authorized

to be paid by the Acts specified in the Schedule hereto, or any

or either of them, shall be deemed and taken to have been legally

and properly paid out of the said respective funds before-mentioned,

as fully to all intents and purposes as if the said Acts had severally

expressly directed and allowed such expenditure to be expended

from such funds; and every Treasurer who has made, or shall make

any such payment as aforesaid, s h d be, and he is hereby indemni-

fied and held harmless accordingly.

accounts, be allowed credit for all sums paid by him in pursuance of such orders accordingly, and the receipts of the persons to whom auch sums shall have been so paid shall be to him a f d discharge for the sum or sums for which the same receipts shall have been

respectively given, and the amounts thereof shall be passed to hie

credit in account accordingly.
