AN ACT to amend the Public Works Act,

1902.

[Assented to 18th September, 1906.]

and Legislative Assembly of Western Australia, in this presentBE it enacted by the King's Most Excellent Majesty, by and

with the advice and consent of the Legislative Council Parliament assembled, and by the authority of the same, as follows :—

This Act may be cited as the Public Works Amendment Act, Short title.

1906, and shall be read as one with the Public Works Act, 1902,

hereinafter referred to as the principal Act.

2. (I.) For the purpose of constructing ally underground work, Acquisition of

land under the surface may be acquired under the principal Act underground land.

without acquiring the surface.

s. 10C.

( 2 .) In such case no compensation shall be allowed or

awarded unless

(a.) the surface of the overlying soil is disturbed ; or

(b.) the support to such surface is destroyed or injuriously

affected by the construction of the work ; or

(c.) ally mine, underground working, spring, reservoir, dam, or well in or adjacent to such lands is thereby injuriously affected.

Amendment of

Section two of the principal Act is hereby amended by

sec. 2.

inserting after the word " road," in paragraph (20) of the definition

of " public work," the words " stock route."

Section nine of the principal Act is hereby amended by striking out the words •• calendar year until such time as the financial year is made to end on the thirty-first day of March, when the report shall relate to all works carried out during the."

Section ninety-four of the principal Act is hereby amended

by adding the words " whether erected before or after the passing

of this Act."
