WHEREAS it is expedient to extend the provisions of an Act of the Governor and Council of New South Wales passed in the second year of the reign of His Majesty King William the
Fourth intituled " An Act for the better preservation of the Ports
" Harbours Havens Roadsteads Channels Navigable Creeks and
" Rivers in New South Wales and the belter regulation of Shipping " in the same " and of a certain other Act of the said Governor and Council passed in the fourth year of the reign of His said Majesty intituled " An Act for regulating the Police in the Town and Port of
" Sydney and for removing and preventing Nuisances and Obstructions
" therein " so far as relates to the protection of Public Wharfs Piers Quays and Jetties and the convenience of persons frequenting the same

An Act for protecting Public Wharfs Piers Quays

and Jetties. [5th August, 1834.]

same Be it therefore enacted by His Excellency the Governor of New South Wales with the advice of the Legislative Council thereof That it shall he lawful for any two or more Justices of the Peace to make and appoint such rules and regulations and the same to alter and vary as occasion shall require for carrying into effect the provi­ sions of the said first recited Act for preventing rubbish being placed

on any public pier or quay and for removing timber and other bulky
articles from the same as therein directed and for the maintenance of

good order cleanliness and convenience on and at every public wharf

quay pier and jetty within the said Colony respectively and such rules and regulations to enforce in the case of free persons by imposing fines and penalties for the violation thereof any such fine or penalty in no case to exceed twenty shillings for any one offence to be recovered in a summary way before any Justice of the Peace and applied as in the said last recited Act is mentioned and in the case of any convict or offender under sentence of transportation by such punishment as is therein authorized and directed for the breach of any of the provisions thereof Provided always That all such rules and regulations as relate to any public wharf pier quay or jetty situate within the boundaries of the Town and Port of Sydney shall be made by the Justices appointed to execute the duties of Police Magistrates within the said town and port And provided also That all such rules and regulations respectively shall be first approved of by the Governor of the said Colony and published in the Government Gazette and that the same shall be painted in distinct legible black letters on a board with a white ground and be put up and continued in some conspicuous place

on each and every such public wharf quay pier and jetty.
