s1 2 s3 Public Trustee Amendment (No. 7) No. 363, 1997 ˙ Short title 1. This regulation may be cited as the Public Trustee Amendment Regulation (No. 7) 1997. ˙ Regulation amended 2. This regulation amends the Public Trustee Regulation 1989 . ˙ Insertion of new s 21 3. After section 20— insert — ˙ ‘ Application of Act, pt 8, div 1A to unclaimed superannuation benefits ‘ 21.(1) Part 8, division 1A of the Act applies to an unclaimed superannuation benefit if the sole, or each, accountable person holding the benefit— (a) is a corporation within the meaning of the Corporations Law of Queensland whose registered office within the meaning of that law is in Queensland; or (b) is an individual whose principal place of carrying on business as a holder of benefits in the type of fund in which the benefit is held is in Queensland. ‘ (2) The division also applies to an unclaimed superannuation benefit if— (a) more than 2 accountable persons hold the benefit; and (b) 1 or more, but not all, of the accountable persons are persons mentioned in subsection (1)(a) or (b); and (c) the principal place where the fund in which the benefit is held is administered is in Queensland. ‘ (3) Subject to subsections (1) and (2), the application of the division extends to the following things and persons to the full extent of, but not to exceed, Parliament’s legislative power—

s3 3 s3 Public Trustee Amendment (No. 7) No. 363, 1997 (a) an unclaimed superannuation benefit situated outside Queensland, whether or not in Australia; (b) anything done or entered into, or happening outside Queensland in relation to an unclaimed superannuation benefit, whether or not in Australia; (c) an accountable person, a member of a fund or a beneficiary situated or residing outside Queensland, whether or not in Australia. ‘ (4) For subsection (1)(b), the types of fund are— (a) an approved deposit fund; and (b) a regulated superannuation fund.’.
